    5 July 2019 - letter from Wescot asking me to contact them as Payplan are no longer acting on my behalf
    6 July 2019 - letter from Wescot stating they would like to offer a reduced settlement amount and asking me to contact them to discuss further.
    26 July 2019 - letter from Wescot asking me to contact them urgently.
    25 November 2019 - Letter from Link stating the account is being transferred from (no name inserted) to Link Financial Outsourcing Ltd and requesting I complete a budget plan.
    10 Jan 2020 - letter requesting to get in touch.
    6 April 2021- Letter of claim recieved from Kearns Solictors dated 6th but received 20th April!!

    22nd Aug 2019- CCA's recieved - to be e-mailed to check for enforceability
    28th Aug 2019 - Response from Niddy - Online application but is questionable
    13 Jan 2020 - letter from Link stating they have not written to me for some time as they had to validate my address. Requesting for me to contact them regarding my intentions to repay the outstanding balance.

    22 Aug 2019 - CCA's received - to be e-mailed to check for enforceability.
    28 Aug 2019 - response from Niddy - This was an online application and they’re using a tick in the box signature. However, Niddy believes it’s UE due to incompleteness of application prescribed terms.
    13 Jan 2020 - letter from Link stating they have not written to me for some time as they had to validate my address. Requesting for me to contact them regarding my intentions to repay the outstanding balance.

    19th March 2025 - letter from Link Financial stating that to re-connect with you our representatives (Resolvecall) will be visiting if i dont contact them.
    25 Apr 2025 - received an Email from Resolvecall stating a home visit is pending!

    Dec 2019 - email received stating offer to pay £868.76 to clear balance.
    July 2020 - email received offering 65% discount (to pay £506.78 to clear)

    11 Oct 2019 - offer of a 10% discount off the full balance.
    1 Nov - Letter Before Claim received from PRA stating I need to complete the form and return within 30 days or I'll be taken to court
    Referred the claim onto Joanna Connolly Solicitors to take forward
    07 July 2020 - PRA have discontinued the claim!!!

    As long as you're still paying the original creditor it's unlikely to be sold. When a debt is assigned it can make things easier for you because the debt purchaser doesn't necessarily have access to the historical data/information making it potentially harder for them to comply with any request for documents. Also our mortgage is with Santander too, so again don't want to open a can of worms by requesting CCA's especially as they are still the debt owners.

    It's not only the credit agreement which they would need to enforce the debt in court, it can be loads of other things such as the Default Notice and proof that they have Title to the debt (assignment issues).

    I can see it's with DrydensFairfax solicitors but who is their client (the current debt owner)? Debt sold to Lowell Portfolio on Mar 2014. Managed by Drydens

    Have you been sent anything threatening such as a Letter of Claim which needs attention since it's £11k? No. Never received any such letter.

    Have you sent a s 77/78 CCA Request to anyone for this debt? No was concerned as the debt is pretty recent and they actually had a courier who came to our address to get the loan agreement signed. Just concerned due to the large amount and recent opening status.

    A compliant Barclaycard credit agreement from 1999 may be a challenge for a debt purchaser to source.

    Would you have opened this in branch or in response to an Invitation letter etc? Hubby unable to recall as so long ago

    Is this another one where Link have not responded to your s 77/78 CCA Request? Yes CCA sent June 2018 and no response received.

    Letter received March 2013 from Barclaycard stating that they had assigned the debt to Link Financial Outsourcing Ltd and they would contact us within 30 days. Upon checking, I have noticed that we have 4 debts in total assigned to Link. We have received statements from them every year for all the other 3 accounts but no statement ever received for this account!!



    If so then sit tight to see what they say or do next.

    Debt No 6
    If this was an Egg credit card from the beginning (2004) which was subsequently bought by Barclaycard it'll be interesting to see what documents PRA produce. They need the credit agreement and the appropriate Ts & Cs from inception. This can be a struggle for them in some circumstances.

    If you've already sent the s 77/78 CCA Request and had a response then email it to Niddy using
    webmaster@all-about-debt.co.uk Emailed to Niddy who advised debt is unenforceable.
