Letter rec'd from Experto Credite: "....following your CCA request....been advise by MBNA they are currently unable to produce a copy....we are therefore aware agreement is currently unenforceable....we will not enforce any action to recover balance....however outstanding balance is still payable and will not be written off....recent court cases confirm: we will register debt at CRA; acc will remain in default; we or third party can still contact you to collect on this account....please contact us...."


Excellent news, I will frame the letter and put it under the Christmas tree with all my other presents (not).

but the thanks really go to you two and this forum.

Over the last few days Experto Credito have been phoning around 15 times a day but I've been ignoring. Now I know which accounts they have been on about I will send them "Telephone harassment" letter, but will wait till after the festivities - don't mind the calls so much now I have them letters and know they are clutching at straws !!

I have 3 accs with MBNA, 2 are the ones I've just detailed which were accs they have bought from BoS and A&L but the other acc is an original from MBNA and as yet have not received that all important letter - although I feel they have no CCA after all this time.

Letter rec'd from Experto Credite along with what they call my CCA. To me it looks like the application form and lots of T&C. In there letter they state "....we consider these documents saticfy our obligations under S78....please make payment in 10 days...."

I can e-mail the documents for you to look over if needs be Niddy.

thanks for looking at the above.

I was quite surprised they produced a CCA after almost 15 months had passed since my CCA request and even more surprised they could find one after 18 years which looks to be enforceable.

I suppose I can't complain as my other 2 Experto Credite/MBNA accounts are


I will, as you say, blag it for now and see what they send next.
