          I write with reference to your letter dated 15th November 2012 and note the content within.

          You’ll excuse my confusion but you’re asking for money from me yet refuse to accept you are the creditor, so please enlighten me then as to how this is supposed to work?

          Regardless, you’re actually quite mistaken in your assertions and the fact that this account remains in a dispute status matters ‘everything’ so the fact you think it does not confirms my stance that you are indeed ignoring legislation and guidance and thus you leave me no alternative but to formally report your conduct to the relevant authorities. In the meantime my position remains, this account is in total dispute based on the balance being ambiguous and incorrect thus no monies will be forthcoming. The normal process for a DCA that purchases an account in such dispute is to recourse it back to the original creditor, something I suggest you do immediately as any further threats or harassment will result in my seeking legal clarity on your choice of actions with a counter-claim possibly forthcoming.

                The letters are starting to flow again after a bit of a lull.

                Letter recieved from LTSB re my visa account deemed UE by the Boss and not paid since July 2010.

                it has been around various DCA's , all of whom have had the templates to suit at each stage and ultimatley have thrown the towel in - hopefully a good sign.

                Anyways I have had a letter today from LTSB ( In a brown envelpoe marked 'URGENT') saying that they have failed to reach agreement with me and have passed my account on to Mackenzie Hall and that I should contact them ASAP to arrange to pay the outstanding balance......

                Question is - do I send Mackenzie Hall a 'sold in dispute' template now or wait for them to contact me and then send it?

                  Hi

                  I had a similar letter from LTSB saying that yet again I was being passed on to someone else.......I waited for the other party to contact me before sending them a letter. They usually have their own reference number for your account, so I would wait. Why make their job any easier.!!

                      Its the usual cycle just before Xmas Matty. Couple of reasons:

                      1) DCA's know that there is a good chance people will have put aside money for Xmas. Therefore ramping the pressure up just before Xmas can 'persuade' people to part with some of this money

                      2) Getting towards end of year so there is always a bit of a push to achieve their collections 'targets' for Q4

                      3) Creditors and DCA's like to offload bad debt off their books before the end of the financial year. So if the likelyhood of collection is slim they will transfer you into a 'package' of accounts that will get sold to another debt purchaser. So the letters are sent out in earnest to establish which accounts to place in these packages

                      4) DCA's want to get some money in for their Xmas party (unless Michael Macintyre is booked for the entertainment in which case they will be sorely disappointed!)

                      If you look through some of the 'old-timer' UE diaries on here you'll see this is typical annual behavior.

                          Quick update

                          LTSB Deemed UE and not paid since 2010

                          done the rounds and each of the DCAs have had the various templates - the latest ones being Moorcroft.

                          After a bit of template ping pong they have written to me saying my account remains on hold to allow me to respond to their previous responses...which I have.

                          But they say to date the do not appear to have received any contact from you - Jokers my last and all previous letters were sent 1st class recorded.

                          Anyway - I was about to kick off and write them a sarcy reply when I read the following a little further down the letter 'should we receive no further contact from me within the next 14 days they will close my account and return it to LTSB'

                          So I will not do anything further on this one for now.

                              Letter received from Rossendales in response to the last letter - They say Arrow have not received a copy of the original dispute with MBNA and have asked that I provide details so that they can investigate the matter - account is on hold for 14 days to enable me time to send them the details of the dispute.

                              Do I need to go to the trouble?

                              I was thinking of writing back and asking them to ask Arrow to contact the OC (MBNA) who are more than aware of the dispute which has been ongoing since July 2010.

                                Coop Visa - Deemed UE - Not paid since July 2010

                                Letter received from Coop - Not heard fromn em in ages , account has done the DCA rounds etc.

                                They have sold account to Lowell - Letter from Lowell in same envelope introducing themselves and asking me to pay the outstanding balance.

                                Guess its time to start over and pop a 'sold in dispute' template.

                                Not dealt with this lot before.......

                                Will keep you posted.
