Looks like Gothia / Redcastle arent biting.....letter received today asking me to fill in an Income / expenditure form so that they can review my account and come to an amicable payment arrangement.

They have kindly suspended all action on my account for 14 days to allow me time to collate this information.

Could send 'em the CCCS I&E form / proposal that ran for the next 16 odd years.....might make 'em re-consider my offer?

Another letter received yesterday from Gothia / Redcastle dated 31-01-2012...4 days after the one above (asking me for I&E details and talking of payment plans etc) saying that their client has contacted them and has instructed them to withdraw and that they have therefore returned my file to them ???
Very strange indeed - I wonder what is coming next......?

Natwest Visa - UE - Balance circa £10K

Moorcroft have been hassling me over this and they have had the 'sold in dispute' and then 'application form recieved' templates to date...

Recieved a letter from them yesterday saying that there is clearly a difference of opinions between me and their client and that they therefore believe that the best course of action was for them to RETURN MY FILE TO THEIR CLIENT.

Lets see who picks this up next.

The problem Matty, with the banks, is they know your accounts are like 500 years old thus they aint risking things cos the chances are they won't have the right paperwork etc, it'll also be bloody hard to cheat so best option to them is to keep returning it.

Hopefully, this time next year you'll have exhausted all the DCA's that are in force thus you'll be left in peace

              M&S CC - enforceable

So here it is - what came next was a letter from M&S , telling me that Red Castle were no longer dealing with my account.
They rejected my F&F offer of £2K and say they will accept £3K which is just under half the O/S balance....to PART settle the outstanding balance.

Me smells a rat here ....although they go on to say later in the letter that they will ' indicate on my credit file that the default has been settled and that they have accepted less than the outstanding balance to settle the account'.

I have 14 days from 10-2-2012 to pay up all they will remove the offer.

Do you think I have a realistic chance of driving this thing lower - as it has been going on a good while now?

Sorry to mither but could do with some advice with this one please.

                M&S's offer expires on 24/02/12.

Is it time to get this one settled or play a little more poker?

They want circa 1/2 the OS debt by 24/02/2012 I have offered circa 1/3rd.

Just to recap it is enforceable and has been going on a while now (offer / counter offer).

                Thanks in anticipation as ever,

                Matty.

Matty who is making the offer? If its m&s write back and say £2k is ALL you can get; take it or I'll pay £1p/m

Attach a copy of your original offer and the reply. See if that works

                    Cheers Boss - will do.

M&S are now making the offer direct as RedCastle / Gothia have returned the file / been sacked.

Would it be worthwhile sending the CCCS proposal (16 year DMP) to back up how deep in th s**t I am?

                    Regards,

Letter concocted and sent off to M&S.

I included a bit about having contacted CCCS and that in accordance with their calculations my offer of £2K equates to 5 years payments if I were to enter a DMP and that I couldnt guarantee making regular payments for a dew months never mind 5 years or the 16 years + that CCCS DMP would run for.

Right - sent off the 'sold in dispute letter to Lewis Debt Recovery.....

Recieved a letter yesterday from Howard Cohen Solicitors (dated 20/12/11 ) sayoing that if payment is not made within 7 days their instructions are to continue with further action against me and that I should seek independant legal advice.

                          Seems like they mean business.

Should I send 'em the threat of legal action template or is it time to try and negotiate F&F?

Anybody had dealings with this lot and if so how did you get on?

                          Cheers

COOP Visa - deemed UE balance £13k+

Faxed 'em the threat of legal action and all has been quite since then...until yesterday.

Received a letter from Lewis 'Without Prejudice' offering a 50% reduction in the balance if I pay up before 5/3/2010.

I am tempted to counter with an offer of 20% but was wondering if in doing so, would it prejudice my positon regarding my UE stance if this were to end up in court.

Any advice much appreciated as ever.

Fair point - should lnow better by now!!

Do I need to answer their letter / offer or just ignore and await their next threat and then respond with the appropriate template....?

                              the latter I guess.

                              Cheers Swanny
