        Update 2-3-2011
        Despite receiving a letter from the BOS last week confirming that they couldnt provide me with a copy of the CCA and therefore prevented from seeking an order from court to enforce it.....I get a letter yesterday from Blair Oliver & Scott (BOS) 'Notice of intended Court action'.
        They have had the threat of legal action template last week.
        I assume I send a copy of their letter to me re them not being able to enforce it - just not sure which template to send it off with or are we into Niddy special territory here?

          Done a bit of digging - though I'd read about someone in a similar position on another thread -I assume that I send this c/w a copy of their letter to me?
          Debtors Final Response - Upon a Lender / DCA claim it is Enforceable

            No mate. Can you confirm, have you previously sent off the threat of legal action or this: CCA Query - Letter Previously Confirming No CCA

            If so, please confirm what, to whom, and when.

              I have not sent the letter as per your link as yet.
              I sent BOS a template letter (old version) 26-07/2010 in response to my CCA request and telling them what they had sent did not comply and as such agreement was unenforceable.
              Since then it has been passed from DCA to DCA.
              Each time it got passed on to a new DCA they got the account in dispute & threat of legal action templates which usually resulted in it being passed on.
              Blair Oliver Scott have had all these and during the course of this going on I received the letter from the BOS saying that they couldnt enforce it.

                Hiya, you need to send this: ---> CCA Query - Letter Previously Confirming No CCA with a photocopy of BOS letter confirming non enforcement. That will sort it.

                            Had a letter back from M&S re this saying that they have complied with my CCA request,that they have provided the agreement along with the terms and conditions and that it is enforceable.They go on to say that their normal collections will continue.
                            Just igmore for now?
                            I will have to deal with this one at some point - when is the best time after receipt of court papers ?

                              Morning all.
                              Update 23-2-2011
                              Got a couple of strange leters yesterday:
                              1: From Moorcroft re LTSB account confirming that they cant find a copy of of my credit agreement as the account is more than 6 years old,but they believe that in any case the balance remains due and they require immeadiate payment or realistic payment proposals....
                              They go on to say that the ICO has confirmed that wheras a debtor is not obliged to repay the account due to the provisions of the Consumer Credirt Act,this does not mean that there was no enforceable agreement.
                              Finally they say that in addition our client will continue to report the conduct of your account to the various Credit Reference Agencies to whom they subscribe and that they look forward to hearing from me in the next 14 days with my proposals for discharging this liability.


                              Not sure what to make of this - other than muppets

                              I have received another letter from Moorcroft (I must be top of their most wanted list) about the above account threatening -possible litigation - even though THEY have written to me saying that there is no enforceable agreement - unbelievable!
                              Not sure what to do:
                              Ignore and let them take me to court
                              or
                              Send them - CCA Query - Letter Previously Confirming No CCA

                              I guess either would suffice.

                                Well done - this is now finished! They have confirmed it is UE by way of that letter, it is NOT enforceable - although yea, they can (and will) hassle you - but so what! Basically, if anyone writes about this debt again, you photocopy that letter (so keep it safe - very safe!) and send it with one of these: ---> CCA Query - Letter Previously Confirming No CCA
