    Oops, ignore that Statute Barred bit as I was paying a reduced amount up until Sept 2010.

        OK well I guess I had better do that, if you think it'll turn nasty if I just ignore them.

        Just that I hadn't heard anything from any of the DCAs for so long I thought I could live in peace. Also I am hoping to move house with my partner next year, after the Paragon debt comes off my CF, as my CF will be clear of any of these debts. Just don't want anything to jeopardise that.

        Should still have my Credit file from a couple of years ago so if Marlin try and start it back up under a different Account etc then at least I can challenge it I guess.

        What a load of granny pants!!!!

          Hi,

          Quick question. Is it best to send a Postal Order rather than a cheque with a CCA request so that they don't have your signature to copy?

                if its a cheque for a £1 you could sign it Mr blobby if you wanted, they will get cashed for such a small amount anyway.

                  Default: 26/06/2004 - £5601

                  29/07/2010: sent CCA request to Wescot
                  03/08/2010: received letter from Wescot claiming to not be creditor.
                  17/08/2013: received letter from Marlin Financial Services requesting contact with them.
                  19/08/2013: sent CCA request to Marlin Financial Services.

                  OK, CCA request sent to Marlin, wait and see what happens now.

                    Hi,

                    Had the pleasure of a letter from Marlin this morning outlining the 'debt' and letting me know it was an Egg card etc. The key part of the letter is:

                    'Unfortunately we do not hold a copy of your Application/Agreement on file and therefore we have applied to the original creditor and will forward this to you upon receipt, whilst obtaining this information the account will remain on hold'

                    Given that the original card was taken out in 2001 and that Wescot weren't able to get hold of a copy I am curious as to what Marlin will 'come up with'.

                    The waiting game begins all over again

                      Hi Again,

                      Not sure if this is good news or bad news. Received a letter from Marlin today with a copy of the Online Application made for the Egg Card. They state that they don't hold a copy of all the information I've requested and have therefore requested copies from the original lender which will be forwarded upon receipt.

                      So, is it good news that they haven't found everything yet or bad news that they found one part and could find the other bits? As it was an online application, they haven't sent anything with my signature on.

                      Really could do without these 'bar stewards' causing problems.

                        Hi Again,

                        Yesterday I received a Statement of Account from Marlin Capital Europe, obviously another arm of the Marlin group. This claims that Marlin Capital Europe are the creditor and outlines how much I owe and tells me I must pay off the outstanding balance. It goes on to say if I don't pay off the full amount then the following applies:

                        "Payments of less than the full amount will be allocated in the following order: (1) to pay any amounts of the interest applied to your account, (2) to pay any costs and charges applied to your account, and (3) to pay the principal sum owed.

                        No interest is currently payable on the amount outstanding"

                        As you will see from previous posts I put in a CCA request and so far all I have received is a copy of the online application. What should I do? Sit tight as they still haven't fulfilled the CCA request? Contact them? I am getting pretty peeved with Marlin as I thought this debt was dead and buried and obviously they apparently aren't the nicest.

                          This sounds like the standard Statement of Account that others have recently received on the Marlin mass purchase thread. Have you been following that Dajomel?

                            I notice that your credit card was taken out in 2001, and marlin state it was an online application. This means you would have had to tick a box to agree the credit card, and as far as I know, all online tick box credit agreements, prior to 2005 (I think?) are UE. If Paul or Niddy could come in and give the exact explanation and the info needed to inform marlin of this, that would be great, you could get them to bugger off.

                              Thanks Elsa and SXGuy. I had read the Marlin thread before but forgot to subscribe to it. I have now subscribed and commented on it so fingers crossed we can all get a good result and a bit of group support
