I've been called many a thing but nevea "dudette" before, quite like that........

with regards to the default, very hard to get removed, especially if you did actually default. I do understand that they have less influence after 3/4 years on your credit record though

Sorry for the lack of updates but that's been due to hearing NOTHING FROM ANY OF THE SCUMMERS!!!!! It is totally quiet on the Western Front that's for sure.

As a slight aside, my mobile contract is coming to an end and I ideally want to get a new one instead of upgrading, so I can get a new number, but I am wondering what the situation might be should the Credit Check fail? Will that show up on my credit file? Is it worth trying so I can get one of these deals or would it be best to go direct to Orange etc?

Many thanks and I hope the rest of you fab bunch are having similar success
        Many thanks,

          Hi All,

First of all I would like to wish everyone a HAPPY NEW YEAR. I hope that 2013 brings you all some peace, solace and respite from the nasty money grabbing cowboys that lurk around every corner.

I am stunned that it has been 6mths since I did an update. I am sooooooo sorry for being so bad especially after all the great help you have all been here. However, the lack of updates has been down to a few things including:

          1) Far too busy with work and family life
          2) Getting engaged (I finally popped the question after an eventful evening in Barcelona)
          3) Helping my partner with her little guinea pig empire and small animal boarding.
          4) The most important thing of all ....

I HAVEN'T HEARD A PEEP OUT OF ANYONE ... INCLUDING THE SHARKS THAT ARE PARAGON!!!!

This means that the last letter I received from any of the CCA's was in March 2012 and more importantly it's been nearly 2yrs since I heard anything from any of the others. I think I can safely say that, with thanks to you guys, I have gotten through this hell and I have to say that I do feel better for it. I am a lot less stressed financially and just feel generally happier about the future now. Getting married this year and fingers crossed, June 2014 is when my default disappears from my File so we'll be looking at finding a new house to start our future in

I do sincerely hope that you all find a way past the nightmares you are facing.
          Many thanks,

          Dave

            Hi Everyone,

I hope that 2013 is proving a better year for everyone and that you're all managing to get on top of your financial issues.

This is just a quick message to say I had a random, out of the blue, letter from Cabot Finance saying that they are unable to find the original agreement. What's odd about this is the fact I requested it nearly 3 years ago and had already heard from them saying the same thing. It's almost as though they are saying "We're still looking!" LOL

Anyway, take care everyone and good luck to you all.

              Hi Everyone,

Hope the Summer and the long awaited appearance of the sun has brought some pleasure and joy to you all.

Just a quick update, not heard a peep out of any of the aforementioned companies since my last post in May. However, I got a letter from Marlin Financial Services claiming they have been passed a debt of mine for £3501.01 that was originally a Barclaycard. Funny thing is, I have never had a Barclaycard!!! Is this a company trying to scam people? Anyone else heard from them?
              Many thanks,

              Dave

Barclaycard bought Egg's portfolio - was it an old Egg card?

Many thanks Niddy. Was unaware of that but now it makes sense.

Curious thing is that Wescot was trying to get the money for this debt but when challenged claimed not to own it. I followed your advice Niddy and challenged this and sent another CCA request and accompanying letter saying they have to resolve the issues of debt ownership and never heard back from them, 3 years ago!!! Can they legally 'sell' the debt that 'doesn't exist' on to another company? To be honest I have a feeling the letter from Marlin ended up in the bin. I'll make sure I keep future ones.

I assume it's a case of just ignore them?
                  Many thanks,

Marlin Financial was Wescot (Egg Credit Card - now Barclaycard?)

                    Credit Card taken Out: 11/04/2001.
                    Current Balance: £3501.01

Full Payment: Unsure at this time. Last reduced payment - September 2010
                    Paying - No
                    Default: 26/06/2004 - £5601

29/07/2010: sent CCA request to Wescot
03/08/2010: received letter from Wescot claiming to not be creditor.
17/08/2013: received letter from Marlin Financial Services requesting contact with them.

                    Hi Again,

Have had another letter from Marlin Financial Services, they really are a pain in the posterior. Don't they know that a CCA request has already been put in and not fulfilled? How do these companies get away with this?

Anyway the letter went along the lines of:

                    Dear Blah

Further to our previous correspondence we do not appear to have a repayment plan agreed to address your outstanding debt.

It is extremely important that we speak with you to discuss your financial situation. Blah Blah Blah

If you fail to respond to us, we must advise you that our client may take further steps to recover your outstanding debt.

                    Yours Blah Blah

Do I put in another CCA request for this 'debt' or just ignore them and see what happens?

Why not ignore them? Surely they have no more powers than another DCA? Wescot couldn't get hold of the original CCA when they had the debt so what are the chances that Marlin will? I did hear from them about 3 weeks ago but didn't respond and believe the letter got thrown out by mistake.

I sent a CCA request off 3 years ago to which they replied saying that they are not the Creditors. I should have that letter filed. I then ignored them as suggested and have heard nothing until Marlin got in touch 3 weeks ago.

Yes I have read the thread and associated info and realise that Marlin are at the nastier end of the scale, though I have dealt with Paragon before and they seem to have disappeared. The thing is, the debt was defaulted back in 2004 so isn't it Statute Barred? Wescot were unable to produce anything despite being requested to do so therefore there is still an outstanding CCA request 'out there'.

What would the suggested course of action be? Send a CCA request to them? Sit back and wait for threats? I'm beyond giving a toss about threats in the sense that they won't worry me etc
