    Sounds like a plan In-2-Deep.

    Just to re-iterate, I sent a CCA Request off in 2008 to CL Finance and heard nothing for 3.5 years and then heard from Lowell who have since claimed that CL Finance never received a CCA Request. Unfortunately I was stupid and have no proof of sending it, though I know I did as I sent 4 off to different companies and the other 3 received them.

    Anyway, would just like a second opinion that In-2-Deep's usually sound advice is the current best course of action (no offence to In-2-Deep)

        Send it. Lowlifes won't read it anyway. The other thing you could do is put Lowells on the back foot and send them the CCA request. They claim to be current owners of the alleged account, therefore they must do the work. It depends just how nasty you want to be. When they started on me I put them on the maximum pain as well by starting them off on a course of AAD medication. It costs a quid plus recorded delivery postage. Pretty big savings there.

        They backed down at the first hurdle and closed the accounts concerned.

          AAD medication? Blonde momemt here but what does AAD mean?

            Hi daj,

            "AAD" is our speak for allabout debt, this very site

            Hence the course of painful medication for DCAs starts with the CCA request letter here:-

            >CCA Request

            and if the response is UE paperwork then it gets more painful for them as the proceedure is followed. It lets them know that you are not just going to roll over, it lets them know that they will have to start doing some work, and all of these templates are worded to ensure that you do not acknowledge the debt in any way and hence once payments have ceased the Statute barring (SB) clock has started ticking as well.

              How I didn't work out the AAD bit I don't know

                Heard nothing since, not even a dispute.
                13/10/2011: received letter stating debt sold to Lowell Portfolio I Ltd
                21/10/2011: received letter from Lowell Financial saying I haven't been in touch about the debt Lowell Portfolio I Ltd now own.
                24/10/2011: sent unenforeable letter to Lowell Financial as suggested.
                11/11/2011: received letter from Lowell Financial
                09/12/2011: received letter from Lowell Portfolio I
                19/12/2011: received letter from Lowell Financial
                05/01/2012: received letter from Lowell Financial

                Hi All,

                Thanks again to Garlok and In-2-Deep. I have sent off a CCA Request letter to Lowell Financial, including a cheque for £1 signed with a different signature, today as suggested.


                Will wait and see what these muppets come with next. As always, I will keep you fab people updated as and when they reply.


                As an aside, I've not heard anything from Transcom/Arrow for 10 months now which is a first for the Paragon debt they are dealing with. I've never gone more than a couple of months before being harrassed by them. I'm sure something will occur soon but enjoying the peace and quiet

                        Just tracked my letter and it was delivered yesterday, 24/01/2012 so I will give them 12+2 days to respond which will take us to 11/02/2012.

                        Lets see what a load of testicles they come up with next

                          Don't forget that after that time, if they haven't responded they are in default. There is no need to send a chaser after the 12 + 2 days. You may know that already, just thought I would mention it in case you were thinking about 'reminding' them.

                            Hi All,

                            Received a letter from Lowell Portfolio I (not Financial who I sent the CCA request to) saying that they have requested a copy from the original lender. Given that they have bought the debt then shouldn't they have a copy already? Also, what are the chances of HSBC having the agreement for a defaulted credit card taken out between 2000-2002???

                              Hi All,

                              An unexciting update but an update none-the-less. I received a letter from Lowell Portfolio I today, as an update for an the ongoing CCA request. It goes along the lines of:

                              We have been in touch with HSBC about the copy of your credit agreement.

                              They have let us know they are trying o retrieive te agreement from their archive. As soon as we have it, we will send it to you.

                              In the event we cannot obtain a copy of the agreement we will write to you again and inform you of this. Once you have seen the credit agreement, we will ask you to pay your outstanding balance in full.

                              -----------------------------------------------------------------------

                              So, we shall wait and see. Next Tuesday is the end of the 12+2 days, though realise they can materialise the CCA at any time.

                              I will keep all you fab people updated as and when I know something.
