    Hi All,

    After waiting, as suggested, I have received a letter from Lowell Financial. The general idea of the letter is to reiterate the fact they have been in touch and "resolved" my query regarding the CCA. In fact, they have not given me a copy and also claim I have not requested it!

    Anyway, they are offering me two repayment plans. If I have any queries regarding the initial request or the payment plans then I should CALL them!! Well, there is no chance of me picking up the phone.

    So, do I just wait and see what they do next? Request the CCA again? An other option?

    Your help and advice is appreciated as always.

        Lowells specialise in buying UE lemons. They ALWAYS say call them they are there to help and all that rubbish. If they start getting heavy then we can respond with something more serious as THEY are now responsible by purchasing your debt for ALL of the liabilities and duties imposed by the CCA and that includes providing you with a complint copy agreement within 12 + 2 days if you ask. At the moment sit tight and see which way they go as I2D has said.

          Hi All,

          Guess what!!! That's right, Lowell have been in touch with a half threatening and half considerate letter. It is a longish letter but I will summarise:

          We wrote after answering a query and offered you an opportunity to pay monthly. We even gave you alternatives but your account remains unpaid.

          As we have answered you query and offered repayment options we assume you are unwilling to pay the debt. We are now going to get your credit file from Experian and us the info to decide what to do. Your credit file highlights blah blah blah and we may also obtain your work details. Dependant on what we see will determine whether we use the Courts or an appointed agent to come to see you face-to-face to discuss repayments.

          We really would prefer to avoid further action. If we use the courts, any costs will be added to the debt but we don't want to increase the debt and cause stress etc etc. We urge you to set up a direct debit and start repaying.

          OK, that's the general feel for it. The main thing is, they claim CL Finance have no record of my CCA Request and that was all they did/said in answer to my letter regarding a previous CCA request. I have still not had CL Finance or Lowell Financial prove they have the original CCA.

          So, as per usual, what would you fine people suggest I do in response to this wonderful literary masterpiece?

              Really? Wouldn't putting in a CCA Request and them not being able to provide it effectively end it?

                I must admit I stopped Lowells dead in their tracks for the moment by firstly telling they had to contact our solicitors as required under s2.8 c and d of the guidleines otherwise Armageddon would be a comfortable place to be. Then I followed up immediately with a CCA s 78 request and a £1.00 PO. Had a letter saying they were referring back to Barclaycard but suggested we settle this as it would be nice not have to sell it back and all of that drivel.

                Well you wanna settle how much are you going to pay me then? barclaycard owe me in six figures. Silence so far!!!

                      see what they say next! Not worthy of a postage stamp to be honest!

                          No mate do as Niddy says, its just the whole thing pissed me off so much over a total of four years that I decided it was time to have a bit of closely structured fun at THEIR expense this time. They bought lemons well suck on this baby.

                              Hi Folks

                              It's that time again where I receive a letter threatening with this, that and t'other from a clueless company that don't really appear to know what they are doing. Anyway, the general gist of the letter is as follows:

                              Your account remains unpaid
                              We have tried on a number of occasions to help you resolve this debt ... which you appear to have ignored. We informed you we would contact a Credit Reference Agency which we have done and will be assessing the information. We will then send the details on to either an agent for a face-to-face meeting, a Court to proceed with court action or a process server who will serve you with a petition for insolvency.

                              Your last chance to pay ...
                              If you want to avoid the above then this is you last chance. If we do not receive payment in full or if you haven't set up a payment plan within 21 days then we will commence with action against you.

                              Again, we would like to offer you an affordable replayment plan ... blah blah blah Please call us today to help resolve the situation amicably ... blah blah blah

                              ************

                              That is the general idea. Is it now time to send a CCA request to temporarily halt things or just ignore as usual? As I am living with my partner and pay her rent, I would rather not have people turning up at the door to bug her!!!

                              Anyway, I appreciate all your advice and look forward to your responses
