    Hi Niddy,

    As you can see with the bottom entry above, I received a letter from CL Finance telling me that they have passed the debt onto Lowell Portfolio I Ltd.

    Accompanying the letter is one from Lowell saying they owe they debt and will now attempt to receover the outstanding debt. If I do not contact them they'll pass my details to Lowell Financial Ltd, they're recovery specialists, to obtain payments.

    I contacted CL Finance in April 2008 asking for the original information pertaining to the Credit Card and never heard from them until today.
    Well they're still in default of your CCA Request so all you need to do is to send this to Lowell and await a response:

    Dear Sirs,

    Account No: XXXXXXXX

    I refer to my letter dated XX/XX/XXXX in which I made a formal request under the Consumer Credit Act 1974 (CCA1974) s.77-s.79 for a true copy of the regulated agreement referred to in the above account number. You have been reminded several times now that non compliance will result in cessation of payment and you were also reminded that you are obliged to supply this under s.189 whether you are the original creditor or not. I also enclosed the statutory fee of £1.00.

    To date you have failed to comply with my statutory request and have defaulted in respect of this account. Additionally this alleged agreement is unenforceable until such time as you come out of default or until it is enforced by a court of law. It is a further offence to attempt to enforce this alleged agreement until such time as your default is revoked. Similarly, in line with recent OFT Guidance surrounding Unenforceability, I presume you're aware that the OFT has stipulated that Sections 77-79 of the Consumer Credit Act 1974 outline the information creditors must provide to debtors under fixed-term, running account & Hire Agreements? Well under these sections a debtor can pay £1 to get:
    1. a copy of their agreement
    2. copies of some of the other documents mentioned in their agreement
    3. a statement of account.

    If this information is not provided within 12 working days the debt becomes unenforceable. This means a creditor cannot:
    1. make the debtor pay the debt before they're supposed to
    2. get a court judgment against the debtor

    As this account is clearly unenforceable, not only am I ceasing all payments toward this account, but I expect you to write back and confirm that no further action will be taken and that the account is now closed and no further correspondence will take place; irrespective, unless you do supply a lawful agreement I will not correspond with you again and any threats will be averred and unlawful and vexatious with a counter-claim forthcoming. In the meantime, I require that you clarify your position on this point as failure to do so, even by omission or lack of a response, will be regarded as an attempt to deliberately misrepresent or conceal the legal position regarding this matter to which an appropriate complaint will be made to the OFT.

      See my last post, you can send either template but being honest the one above is more suited as they are in default of your request! Well, Lowell aren't but you have proof you sent a request to the last DCA right? Fine....



      On another note, this entry should be totally removed from your credit file - can you clarify that is the case?

        Well I have a copy on my PC of the original letter I sent to CL Finance requesting evidence of ownership of the debt and heard nothing since.

        Yes, this has been removed from my credit file. The only debt remaining on the file is the Paragon one, which I still haven't heard anything.

            OH OK, I did send it recorded delivery but chances are I may have inadvertently thrown it away given it was 3.5yrs ago!!! Oops

            I'll make sure I send this one recorded and keep the receipt safe!!!

                    So, what is the ruling regarding 12 working days to respond?

                    I sent the letter to Lowell Financial on the 24th (recorded delivery) which means they would've got it on the 25th. By my reckoning today was the 12th working day and I have heard nothing.

                    What's next?

                    Also, slight tangent, would it be wrong to sign a letter with a false signature? What I mean is, sign it but not with your normal signature so that if they come back with 'proof' showing that signature and not your normal one you can report them for falsifying documents. That make sense? Was just a thought I had

                      Just ignore Lowell for now ... they are in default of your CCA request.. lets see what they do next

                        Got a letter today, 14 days after I they received mine, saying the following:

                        Thank you for your recent correspondance, the contents of which have been noted.

                        We can confirm that your account is currently being queried with CL Finance Limited with regards to your concerns raised.

                        We will be in touch upon receipt of further information, but please be assured that your account is on hol in the meantime.

                        Thank you for your patience in this matter.


                        Guess it's just wait and see what they come up with.

                            Anyway, the letter goes along the following lines:

                            Thank you for enquiry ... blah blah blah

                            After noting your comments, CL Finance advised they have no record of a CCA request made to them.

                            We trust this now resolves your query and look forward to hearing from you to discuss repaymenr. If we have not had contact in the next 14 days, your account will be transferred to our debt collection agent Lowell Financial who will contact you regarding this account.

                            So, I am guessing they are talking out of their backsides given that at the time I sent the CCA request, CL Finance stopped chasing for money. Anyway, I guess the next course of action is put in a CCA request now??? Any and all advise very welcome as always.

                                Hi All,

                                After waiting, as suggested, I have received a letter from Lowell Financial. The general idea of the letter is to reiterate the fact they have been in touch and "resolved" my query regarding the CCA. In fact, they have not given me a copy and also claim I have not requested it!

                                Anyway, they are offering me two repayment plans. If I have any queries regarding the initial request or the payment plans then I should CALL them!! Well, there is no chance of me picking up the phone.

                                So, do I just wait and see what they do next? Request the CCA again? An other option?
