      Hah brilliant. Gotcha! It's unenforceable...... :UE

      Basically, on the right where the insurance policy is, it does not show the specific apr or value (ie £40 odd) of the insurance - that equates to UE!! This explains in detail, exactly what I am disputing: ---> viewtopic.php?p=12111#p12111

      So, lets look at your loan details:

      1. Loan Details

      2. PPI Details

      Now according to the examples set here: ---> viewtopic.php?p=12111#p12111 there should be a clear separattion between the actual monthly amount and the PPI amount, in essence the PPI values should read IDENTICAL to the loan variables, so it should show the premium, the apr then add the two together and give a total premium. That is what should happen. As you can see with yours, shown above, this is not the case. The loan element is correct; it shows the apr, the amount of credit and the repayments. The PPI element is incorrect as it only shows the premium and then the total. There is no apr nor is there confirmation of "how many payments" to make, in respect of the PPI element - as such this makes the WHOLE agreement and loan, unenforceable. Point is, what would happen if the apr of the loan element was 100% - how would you know? - You wouldn't would you......

      So, you would respond as follows: ---> viewtopic.php?p=1503#p1503

        Anyway, thanks for the info and I have posted the letter you suggested. Will now await their reply.

        Fingers crossed they will confirm :UE but this is Paragon so I don't expect them to go quietly. BRING IT ON!!!

            OK. Received letter from Arrow today claiming they dispute unenforceability (no surprise there).

            I did as I was told and didn't worry or panic. I calmly scanned the letter and emailed it to Niddy and updated my diary!!! Aren't I good??? LOL

            Anyway, you should have an email from me Niddy and look forward to your reply.

              CBS Transcom are part of Arrow Global..... wonder why they omitted that useful info in their response (muppets) and instead made it out that they'd "sold it" - lol.

                I did wonder what was going on with the companies as I send everything to Transcom and then get a reply from Arrow saying they'll deal with this one request but all future correspondance should be made to Transcom. Bizarre

                  Hiya, ok had chance to digest things and to be frank there isn't much for me to say so i'd suggest you ignore that letter for the moment and let us know if and when anything else comes.

                  No response is really necessary, we'll defend whatever they send next - when they send it (whatever it may be)!

                    Thanks for the advice Niddy. Will sit tight and wait for the next load of rubbish from them. I am guessing potential legal action so a nasty letter from their solicitors will be sent to try and scare me.

                        Liking the new look Forum Niddy!!! Not too impressed that you took data backup the day before I posted the following message though LOL Just Kidding.

                        Anyway, on Monday 10th I got a letter from Transcom, saying they are working on behalf of Arrow and that they have noted they've not received any payments since September. They have also said that I now have to pay them £390.01 immediately and then start paying the same amount monthly.

                        In addition to this, they now claim I owe nearly £32K!!! This is despite the account defaulting at about £22K. I thought they can't add interest to a defaulted account?

                        Any advice, suggestions, hitman names etc that you maybe able to give me would be fantastic.

                          Hiya, what is the state of the account? I need some history please...? (I don't have time to read back through all the posts, you need to give me some history when you update the diary!).....

                          As for interest, don't worry about it you can argue that if and when it ends up in court! However, they can add what they want to the debt, its only numbers - doesn;t mean you'll pay it right? But technically, once an account has been defaulted then that is the amount owing - pay that and the account would legally be cleared as you've cleared the defaulted sum.

                            Here are the details as shown on my second post

                            ARROW GLOBAL/TRANSCOM (Originially Paragon Unsecured Loan)

                            Loan taken Out: 09/05/2000
                            Current Balance: £22925 according to Credit Report. £31200 approx according to letter from 10/01/2011.
                            Full Payment: 13/11/2002. Last reduced payment - September 2010
                            Paying - No
                            Default: 10/06/2008 - £21,691

                            29/07/2010: sent CCA request to Transcom
                            12/08/2010: received letter from Arrow claiming they are not the creditor but are requesting from creditor
                            16/11/2010: received letter from Arrow with the Credit Agreement, Statement of Account and Terms and Conditions.
                            20/11/2010: sent Missing Prescribed Terms letter to Transcom
                            16/11/2010: received letter from Arrow disputing unenforceability. Letter emailed to Niddy.
                            10/01/2011: received letter from Transcom saying I owe them monthly payments of £390.01 starting immediately.

                            If there is anything else you need then let me know.

                            Sorry for not having given any details in my last post but I thought the idea was to update the initial post with all the details. In the future I'll remember to copy the info into the post I make.
