        No! Ignore for now....
        I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

            Dejavu - sure we discussed this last night
            I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website.                   Another letter received today from Cabot, they certainly respond quickly, it's only a few days since I wrote my last letter to them, maybe because they now own three of my former card accounts which together total over £20K, I may be on their priority customer hit list....

                  Anyway here is a copy of the latest correspondence received...

                  Looks like they plan on ignoring my plea that the application form does not comply as it does not contain all the T&C.....

                      Citi Card account (owned by Cabot)

                      This looks like it may start to get heavy, Opus have sold my account to Cabot. As this account is a biggy (£16K outstanding with the interest that was added on), they are not likely to let this one go on too long.

                      They have sent me three letters in the time I have been away, last one state’s that they have checked with Opus, and they confirm I received all copies of my CCA from Citi Financial to satisfy my request under s. 78 CCA (1974) Therefore unless I make arrangements to begin a repayment programme, they will order their collections dept. to commence proceedings within 14 days.
                      Another letter received from Cabot, much the same as the Capitol One account response in my previous post, but a little different in the fact they are waiting to get a signed copy of my agreement from Opus/ Citi
                      which I will be very surprised if they come up with one, as Citi could not do since I first applied for my CCA from them back in early 2010.
                      but nevertheless, Cabot still insist it is fully enforceable.

                        Ok the part about you shouldnt have signed if you didnt have the terms, is , with respect, bollocks,

                        if the creditor fails to serve the terms which contain the prescribed terms it is very serious and not something that can be overlooked

                          So informally off the record, would you suggest I inform Cabot accordingly by referring to Harrison v Link or maybe wait and see how the account escalates ?

                            Ok having not had a response from Paul to my question above due to;
                            1. Paul has not been back to visit my diary.
                            2. Paul has decided it would be Inappropriate to comment personally (which I would respect)

                            I have decided that as I am going to be working away overseas from weekend until after Christmas, that in the interest of maintaining dialogue with Cabot as they appear to be "Litigation Happy", I will write back and point out the seriousness of Capitol One Bank accepting my signed application form and opening the account when having failed to supply the terms of the CCA to me.
                            I may also remind Cabot to look at the Harrison v Link case.

                            Any comments or suggestions regarding the above gratefully accepted.
