Re: Alland UE Diary
Thanks Niddy,
I must admit I have been getting a bit stressed with one thing and another....
Due to soon having to be out of UK for almost 6 weeks, and will no doubt come back to quite a bunch of unopened "Begging Letters" I am trying to respond to anything I need to in an effort to stall the "demands" process until I am back and in a position to continue with the correspondence.
That's the only problem with being away for so long, those nice people from the DCA's and banks might think I am purposely ignoring them....
Which of course is not true, because I so enjoy debating our mutual interest in my financial affairs...

Allan
Don't stress at LTSB - they are just putting the frighteners on you (seems to be working as well)..... calm down, have a coffee and chill
Just ignore their recent letter of 20th May, it's a typical threat. The bank themselves rarely take action, it's not even been passed to a DCA yet so you've a bit of a way to go yet with this I suspect!

LTSB Card
Responded as per Niddy's instructions above.
Today I received a long winded letter directly from LTSB.
Below is a small section taken from the letter.
"LTSB do not accept that we have not complied with my CCA s78 request, and as far as the bank are concerned the account is fully enforceable, and it is a complete misapprehension that section 78 provides debtors with the right to obtain a copy of their original signed agreement. " This is not what the CCA provides for and, in fact there is absolutley no requirement under under the CCA to provide such a document" So despite claiming to give notice that the account is in dispute, you have given no valid reason to dispute the debt."
They go on to quote different court cases including Carey, and others, and basicly say, "so come on pay up or else !
Emailed the letter to Niddy for his opinion as to how to respond to this one.

Another letter received from RMA today......
"Despite attempts to reach a suitable agreement on the repayment of your outstanding RBS account, to date, the full balance is due in payment.
Our clients instructions to us are clear in that under the terms & conditions of the contract you have signed, the full balance is now seriously overdue.
Please understand that unless we agree suitable repayment terms with you, we may proceed to complete a pre-litigation report in which the following information must be provided in writing by you:
*The full name & address of your empoyer, together with your annual salary.
* Your full residential address upon which a court summons may be served.
* Details of any properties you own together with the amounts of all prior charges.
This is not our preferred course of action but if left with no option we may begin enforcement proceedings against you as our attempts of voluntary solution have failed.
Unless we hear from you immediately, we will then progress to gathering the nessessary financial information to support that recommendation while the account remains unpaid and the account unresolved.

RBS M/Card (Deemed UE)
Letter received from RMA.
"Please accept this letter as notification that due to non payment, your above RBS account has been passed to RMA, a third party debt collection agency who are authorised to act as agents for RBS Bank to recover monies outstanding.
As stated in the formal demand previously issued to you by RBS, the balance stated (£6,560.81) is now due in full, and RBS requests that you pay the amount immediately. RBS will no longer accept any further communication from you therefore you should direct all communication and payment to RMA.
If you are unable to repay your debt in full you must contact RMA in the first instance to arrange a suitable payemnt arrangement to avoid further action".
Another letter received from RMA today......Originally posted by Never-In-Doubt View PostYou could play silly buggers and write back just saying you require sight of assignment deed prior to communicating with them, otherwise you'll continue to communicate with the original creditor, RBS. See what they say to that!
Although, we both know they have not been assigned the account, they have simply been asked to pursue the debt on behalf of RBS so you could do the above; or just send this instead (you decide): ---> Debtors Final Response - CCA Received

LTSB Card (Deemed UE)
Today I received a letter from Nelson Guest & Partners Solicitors.
"We have been instructed by Wescot Credit Services acting on behalf of Lloyds TSB regarding the above outstanding balance (£12,827.32) As a final attempt to avoid further action, Wescot is prepared to offer you a discount to settle your account. (it does not say what that offer is)
This offer is only available for a limited period. You should contact Wescot by 22 April 2011 to agree a suitable settlement, or the offer will be withdrawn and further action will continue to recover the full outstanding balance of £12,827.32
If you are unable to take advantage of this offer, Wescot will still consider a realistic payment plan, and you should contact them urgently to dicuss your options. Unless a suitable repayment plan is reached with Wescot within 10 days of the date of this letter, further recovery action will be taken".Responded as per Niddy's instructions above.Originally posted by Never-In-Doubt View PostSend this to Wescott: ---> Debtors Final Response - CCA Received
