    A&L could never RoSO with the card once it went to MBNA as they are separate entities, kinda like A&L having an agreement with MBNA but the overall debt was MBNA - it's not like MBNA provided credit for A&L, such as GE Money did with most stores...

    A&L actually sold their customerbase to MBNA thus RoSO can never occur.

        Bit like getting a Post Office card - and having A PO account. As the PO card is issued by Bank of Ireland, the PO could never set-off, as it's not their debt, if you see what I mean.....

          Hi

          Since we stopped paying the DMP in October we have sent nothing to LLoyds TSB. Of the stuff with them the only one that is being chased it the smallest (£941) we have had a couple of "you are late with your payment" letters for the one account but nothing at all for the two largest, should I send any template letters to them or wait until they start communicating with us? Let sleeping dogs lie and all that.......

                      Hi - would appreciate any help/advice on this please..

                      have a solicitors letter from gpd solicitors re Lloyds 4 account in diary. this is old current account. Been given 7 days to pay or they will be issuing a CCJ.

                      All 4 of the old Lloyds accounts are not covered in same way with the CCA as the other cards and loans so UE was always going to be more tricky....

                      Now in bizarre position as relative has offered us £3800 to pay off just these 4 accounts. Have read all templates and info on the site so know how to work the formula out of what to offer etc. I am guessing that now would be a good time to do offer letter but do i do it to iqor or do I do it to the solicitors?

                      Also the account Lloyds 1 (the former business account) we havent as yet had any letters about so dont really want to be making an offer no matter how small to a "sleeping dog!"

                      Any thought on the way to play this would be great!

                        just for starters, solicitors don't issue CCJs, the would have to take you to court and the court would then go through the procedure and the judge would decide whether or not to give you a ccj, you would of course have a opportunity to defend if you chose. These DCAs drive me mad with the way the toss CCJs around like they have the power, they don't.
                        So if this went to a CCJ do you have a defence and is it worth fighting or is it better to try to pay them off?

                        personally if you haven't heard from any of the others, I'd try and pay off this one, with a suitably enticing F&F, how much is this one? I'd sit on the rest of the money until you felt the time had come to F&F the others, its a game, you have to F&F when it suits you to get them off your back BUT pay the least amount of money possible to the shysters.

                          This one with Lloyds is £941 but was only £480 before all the charges were applied and for the 4 years we paid thru DMP they only had £2 a month.. any suggestions on on what sort of amt to offer?

                            11/12/11 letter from capquest asking for immediate contact. ignorig as no resonse to missing prescribed terms yet.
                            28/12/11 LETTER BEFORE ACTION recd from capquest but no sign of missing prescribed terms
                            3/1/12 threat of litigation template sent on niddys advice
                            7/1/12 Capt 1 write to thank me for advising them new address - guess capquest did that!
                            9//12 my advisor at cabot writes introducing himself and that they are apparently going to have to start litigation
                            11/1/12 Capquest write they were not aware of dispute so they have referred back to capt 1 and closed the account on their system..funnily enough not signed by my advisor!!!!
                            7/4/12 letter from Fredrickson International who have been instructed to collect the debt! Maybe Capt 1 think that if they try enough collection agencies we will forget they havent sent thru prescribed terms yet...lol

                                recd a solicitors letter from Green & Co ( making it a hat trick 3 solicitors letters in 3 days!
                                It gives us "one final chance" to make payment or they will commecnce court proceedings despite the fact that Mint are still investigating our complaint (it was only a request for CCA origianally that they have never actioned as they wnat it SIGNED

                                28/12/11 responded with sig not required template

                                11/1/12 mint have sent sig req template letter back as its not signed!!!!!!

                                17/3/12 Trition say we must send £1 PO and sign letter and send it to them and then their client will send copy of CCA
                                11/4/12 Mint write to say they are sorry to hear that we are not happy with how they have communicated with us and that they will investigate and come back to us by 30th May...lol
