    Restons and Cabot may not have joined up the dots. You may need to do that for them.

    Thanks for your reply. I have had no response from Cabot to the CCA request that i sent on 3rd September and the deadline Restons have given me is the 19th October. I will email a copy of the letter from Restons to both you and Niddy.

    Yes the creditor can issue legal proceedings whenever they feel like it but whether they'll be able to enforce the debt in court is another matter.

    Can you please clarify if you've had any acknowledgement or response to your recent s.77-79 CCA request to Cabot?

    If the creditor (Cabot) or their solicitors (Restons) do issue a summons this claim will be in the Fast Track with costs consequences for both parties. Let's focus.

    What is the "date" deadline "to get in touch" stated in the possible LBA from Restons?

    Maybe it would be wise to email a copy of that letter to Niddy using webmaster@all-about-debt.co.uk and a copy to planb@all-about-debt.co.uk

    TSB Loan Marlin/Cabot update:

    Hi all,

    I did as Niddy advised and sent a new CCA request to Cabot 4 weeks ago. Last week i received a letter from Cabot saying as i have not been in touch they have referred my account to Restons Solicitors. Looks like Cabot have completly ignored the CCA request and I have now received a letter from Restons in which they give me a date to get in touch by or they will issue court proceedings. As you will see they are also offering me a discount on the outstanding balance if i call them.

    Please see their letter below. I would be grateful for any pointers on what to to do next as my understanding is that they cannot issue proceedings with a CCA request outstanding?

    Hi Pixie, yeah that's correct. Their letter above does not mention anything threatening. I could always risk it and see what comes next. Another option would be for me to refer them back to my mpt's letter which I sent to Marlin a good few months back although they did reply stating that the terms are present?

    Marlin/Cabot TSB Loan

    Hi all,

    After replying to cabot with a formal LBA response, today i have received the following letter.

    As for Cabot saying that they have not received a CCA request. Marlin sent a letter in Feb this year saying that they have merged with Cabot and as i sent a SWID to Marlin when they bought the account back in Jan 2014 i did not send a fresh CCA to Cabot.

    Any ideas please on how to respond to their latest letter above?
