    Hiya

    That letter is self explanitory no? they're saying they have no proof of CCA request so surely you copy the original request with a print of the proof of postage and then you send it to them and state that the account is unenforceable until such time they do respond and as you already paid, you do not need to pay again as the original s.78 is still outstanding.

    Or you can ignore them, but if this has just been sold then simply reply and let them know what you've done and when you paid.....

          just an update on my barclaycard accounts(2),which were sold to mkrr
          i sent them a copy of my CCA request and proof of postage that i sent to barclaycard in june 2010.
          they came back with, `we will liase with barclaycard on this matter and will keep you informed`
          i wont hold my breath, wont bother sending you a copy of the letter as it doesnt say much more than i quoted and i know your time is important
          will keep you updated

                    I have received a letter today from Howard Cohen solicitors Notice of Pending Legal Action
                    The letter is dated 2/1/2016 and I have just received it today 13/1/2016,if you notice 11 days since it was written,and they have asked me to contact them within 10 days of the date of the letter,or we will issue proceedings in the county court.I know I will need to reply to this letter and have therefore emailed you a copy of it today for your advice as to the next move.I know your busy so I dont expect a quick reply.

                        Send the LBA response as Niddy says.

                        Does that Howard Cohen LBA have a postmark on the envelope? If the letter you received today is dated 2nd January giving you 10 days to respond (which expired yesterday) then they've not been fair to you especially if it's come out of the blue after months/years of silence.

                        Which debt is this for? If the history is posted somewhere on your UE Diary then can you put a link to it, or quote it here so we've got the up-to-date information.

                            This debt is for a Barclaycard taken out in the 1980s.

                            I sent off the CCA request on the 17/6/2010

                            CCA reminder sent 1/7/2010

                            Barclaycard sent overdue letter 9/7/2010

                            Last payment made 25/5/2010

                            Mercers sent a Default notice 9/9/2010

                            I contacted Equifax about the default notice

                              Experian found no default on behalf of B/card 8/10/2010

                              Mercers overdue account letter received 11/10/2010

                              B/card sent a recon. copy 18/11/2010

                              I sent a response to copy doc. supplied 22/11/2010

                              B/card then sent a letter to say ,Due to circumstances beyond our control,we no longer hold a copy of your executed agreement.Reg 9 of the CNC regs confirms that, in such circumstances, for accounts opened before 19/5/1985/(such as yours) the copy agreement we provide may comprise an easily legible statement of the current termsof the agreement.I showed Nid that letter and it was deemed as UE. 18/11/2010

                              B/card sent a copy of terms and conditons 18/11/2010

                              B/card sent a Final response letter and forwarded me to mercers 26/11/2010

                              Calder then ask for the full amount 10/12/2010

                              I sent Calders a Final response letter in return 29/12/2010

                              B/card then sent me a reply to that to say that the ref. to S.127(3) of the act was irrelevant 14/1/2011

                              Calder sent me a letter to say -Notice of intention to sell your debt- they had passed the account back to B/card 12/12/2011

                              B/card then replied with a Formal demand for payment letter 1/2/2011

                              B/card then told me they had assigned me to MKDP 25/3/2011

                              MKRR then politely asked me to pay what i could 8/4/2011 and on the 26/4/2011

                              I responded with I deem this UE 11/5/2011

                              MKRR replied saying that they have no record of any CCA request 17/5/2011

                              I replied with a copy of the original request made on 17/6 2010. 3/6/2011

                              MKRR replied that they will liaise with B/card 13/6/2011

                              2 years later

                              MKDP we are still liaising with B/card 8/5/2013

                              MKDP sent a recon.aggreement 21/5/2013

                              MKRR sent a Final Notice letter and they would instruct their pre-legal dept. 12/6/2013

                              I replied with Threat-o -gram letter 17/6/2013

                              MKRR sent a "we have no option but to send this to Raven Recoveries" 27/6/2013

                              Raven Recoveries demanded full payment 30/7/2013

                              MKDP then sent a This is our final response letter 5/8/2013

                              I replied with Creditor refusal to accept UE 5/8/2013

                              Raven Recoveries replied we demand full payment 4/9/2013

                              MKDP replied with "If a copy of an original signed agreement is not available,an unexecuted agreement is applicable." 9/9/2013

                              Raven Recoveries then replied that they had no option but to pass me over to Keynes Collections for litigation consideration 3/10/2013

                              1 year later

                              MKDP told me that I still lived at the same address 24/11/2014

                              1 year later

                              Robinson Way joined in with a range of payment options for me to consider 7/10/2015

                              Hoist portfolio decided that they would like to be assigned my account from MKDP and did as of 21/9/2015. 7/10/2015

                              Robinson Way then offered me a no min.payment plan 21.10.2015

                              Robinson Way then advised me that I had been transferred to Howard and Co. solicitors in the next 10 days who will consider court action 1.12.2015.

                              That brings me up to date,I have sent off my LBA letter and will keep you informed as to what happens.

                              There was no date on the envelope.

                                This is an update on that LBA letter I sent to Cohen and Co. as advised by you and promptly posted on the 15/01/16.



                                Obviously they are not able to supply the Docs. as per the letter.I would be grateful if you could advise as to what move next.

                                I know that I got a recon.copy in 2013,and sent off the appropriate template letter in response,but being this far down the line I'm not sure if I need to reply to this.

                                I guess I'm not sure what they'll do after that date of the 22/02/16.
