Hi,
I have received a letter from Russell Aitken Solicitor Debt Recovery re Lowell - Barclaycard.
Basically saying pay up or we will recommend our client take you to court.
Has anyone had dealings with them?
I have sent a Account in dispute letter

Seems like Lowell are spreading the collectors about.
Letter received from Fredrick international (Do not ignore - Immediate payment required)
Has anyone had any dealings with these people?

It’s all being quite for a while no collectors hounding me.

This was a BOS duel credit card application Visa and MasterCard. I handed the MasterCard back after a few years.
1st credit has sent my application form and terms and conditions that are
from 2008 onwards and not for my application of 1995.
In 2009 I received a letter from BOS stating they cannot find my historic terms & conditions.
I hope that this makes sense?

Copy agreement/Contract
We attach a 'True Copy' of the relevant agreement which fulfils our obligations under Section 77/78 of the Consumer Credit Act.
We require you contact us within 14 days to arrange payment of your outstanding account. If you do not make contact with this office, we will have no option but to consider legal proceedings against you. If successful it may result in;
- Substantial Legal costs and interest being charged thereafter.
- Entry of your name in the County Court Register of Judgements, Orders and Fines making it very difficult to obtain Credit in the future.
Subsequent failure to make payment could result in enforcement action;
- An application to your employer for an attachment of earnings.
- Seizure of your assets by a County Court Bailiff.
- A charging order against your property, (if owned by you).
If you are not resident in England or Wales legal enforcement action will be in strict accordance with the laws relating to the Country of your residence.
If you believe there are any inconsistencies with the document we have provided then we require you confirm this in writing. Please be assured the matter will be investigated immediately.

Can you clarify, what do you mean it's not the agreement - did you have several HBOS products? This is for their old dual visa/mastercard I presume, ie 2 cards one shared limit?
OR do you mean they've sent a recon terms which do not comply, well I can tell you now they're not the same terms you agreed to - that's obvious, but changes nothing (ie it's still unenforceable)....
If so, what account do 1st Credit presume this is...? If not, then it's simply a recon of terms so you send back this ---> CCA Query - Missing Prescribed Terms
