Just ignore for now see what they do next.....Originally posted by Free View PostHi,
It’s all been quiet from the DCAs.
I have recently received a letter from Lowell in regards to my MSDW/ B Card account.
Niddy advised me to send a ‘CCA Query - Application Form Received’ template.
Then they went quiet.
Please see letter below
‘Thank-you for your recent enquiry regarding this Barclaycard account.
Your comments have been noted and after corresponding with the original creditor, Barclaycard, we can confirm we have reached an outcome regarding the matter.
Barclaycard have checked their records and have confirmed that they have complied with your Consumer Credit Act request.
We trust this now resolves your query and look forward to hearing from you to discuss repayment. If we have not had contact in the next 14 days, your account will be transferred to our debt collection agent Lowell Financial who will contact you regarding this account’.
Nothing else in the letter apart from the above.
Any comments, help and advice please.
Thanks

Re: Free's UE Diary
Just ignore for now........ see what turns upOriginally posted by Free View PostHi,
UPDATE
Just received a letter from 1st Credit see below...
We refer to your recent communication requesting a copy of the relevant agreement.
The document you have requested is retained by our client. We will therefore advise them of your request and arrange for the document to be sent to you as soon as possible.
Should your request also include the below documents, please be advised of the following:
Deed of Assignment- we would refer you to Section 136 of the Law of Property Act 1925 which provides that the debtor is notified of the assignment of the debt in writing and not a copy of the Deed itself.
Copy statements-there is a charge of £ 10.00 for this information.
On receipt of the copy agreement we would expect you to contact this office immediately to arrange settlement of the debt.
Please call this office should you wish to discuss this matter.
In regards to the above letter -- a few points.
• Deed of Assignment-
I thought that they had to provide this when they bought the alleged debt
• The document you have requested is retained by our client-
Why is it if 1st credit has bought this debt which they say they have - why don’t they hold this document?
Thanks

Re: Free's UE Diary
Hi,
Just received a letter from 1st Credit (BOS)
I still have not received a CCA from them despite sending this request to them recorded delivery.
They have managed to get hold of my mobile phone number.
These people are becoming a pain in the bum.
Any advice please on this.
Thanks Free
See letter below.
‘We have written to you on numerous prior occasions in regards to your BANK OF SCOTLAND PLC account. However the debt still remains unpaid.
If we cannot agree repayment terms then we will be left with no option but to consider legal proceedings against you. We would of course prefer to resolve this matter by reaching a mutually agreeable repayment arrangement.
PLEASE ACT NOW TO AVOID AN AGENT ATTENDING YOUR PROPERTY.
As a gesture of goodwill - we invite you to make us an offer of monthly repayments on our Direct Debit mandate form on the reverse of this letter.
We require that the payment plan is paid monthly and we will accept your offer provided we receive all the monthly payments.
If you wish to speak to one of our agents please contact us on 0843 320 0015 quoting your reference’

Re: Free's UE Diary
Hi Free,
Sorry to disillusion you over this, but all the mobile telephone companies actually make money from selling databases to the likes of indian call centres including your details and mobile phone numbers. We had Vodaphone contract phones until this year and they were in the vanguard of this particularly dubious way of doing business. There was hell of a row about it in the papers and the regulators promised to put a stop to it. Obviously the brown envelopes have been changing hands and our weak kneed lily livered regulators have bottled it again.
We are now pay as you go, told Voda to stuff their contracts where the sun don't shine, the only thing is T-mobile refused my user name of Gadaffy Duck

regards
Garlok

Re: Free's UE Diary
Hi,
I have just had a text message from 1st Direct demanding I call them and stating that I owe them X amount of money.
‘1st Credit are now dealing with your account of £xxxxxxxx in relation to the Bank of Scotland PLC. Call us urgently on A PREMIUM NUMBER quoting XXXXXX'
I have never given my mobile phone number out to any debt company let alone a credit company.
This must be some kind of breach of data protection.
This number could have been anyone’s
I still have had no CCA
Thanks Free

Re: Free's UE Diary
Oh if I told you that as a result of my fight with these clowns; their head of consumer complaints (Bob Kingdon) pops in now and again so he'll read this and hopefully get a recon sent - then we'll take the real fight straight back to his lap.
Don't worry. Just sit tight.

I would file and ignore with the rest of it until such times as they make a threat in writing.

Re: Free's UE Diary
Hi,
Just another update on 1st credit.
Again today I have received another letter stating ‘Act now to maximise your discount settlement amount’
It continues; 1st Credit believes in helping its customers
It offers
Pay within 7 days discount of 30%
Pay within 8 to 30 days discount of 20%
Pay beyond 30 days 10% discount.
I have no desire to do this or to respond to this letter.
Also just to keep you updated 1st Credit has not provided me with a CCA.
