    Hi,

    It’s all been quiet from the DCAs.

    I have recently received a letter from Lowell in regards to my MSDW/ B Card account.

    Niddy advised me to send a ‘CCA Query - Application Form Received’ template.
    Then they went quiet.

    Please see letter below

    ‘Thank-you for your recent enquiry regarding this Barclaycard account.

    Your comments have been noted and after corresponding with the original creditor, Barclaycard, we can confirm we have reached an outcome regarding the matter.

    Barclaycard have checked their records and have confirmed that they have complied with your Consumer Credit Act request.

    We trust this now resolves your query and look forward to hearing from you to discuss repayment. If we have not had contact in the next 14 days, your account will be transferred to our debt collection agent Lowell Financial who will contact you regarding this account’.


    Nothing else in the letter apart from the above.

    Any comments, help and advice please.

        Barclays confirming it complies, and it actually complying are two totally separate issues and should never be confused as being accurate - as above, just ignore for now and see what they say next

          Hi,

          Just an update.

          1st Credit has sent me yet again a copy of my application form. In this letter they enclosed terms and conditions not linked to my agreement.

          See letter below

          Copy agreement/Contract

          We attach a 'True Copy' of the relevant agreement which fulfils our obligations under Section 77/78 of the Consumer Credit Act.

          We require you contact us within 14 days to arrange payment of your outstanding account. If you do not make contact with this office, we will have no option but to consider legal proceedings against you. If successful it may result in;

          - Substantial Legal costs and interest being charged thereafter.
          - Entry of your name in the County Court Register of Judgements, Orders and Fines making it very difficult to obtain Credit in the future.

          Subsequent failure to make payment could result in enforcement action;

          - An application to your employer for an attachment of earnings.
          - Seizure of your assets by a County Court Bailiff.
          - A charging order against your property, (if owned by you).

          If you are not resident in England or Wales legal enforcement action will be in strict accordance with the laws relating to the Country of your residence.

          If you believe there are any inconsistencies with the document we have provided then we require you confirm this in writing. Please be assured the matter will be investigated immediately.

          Thank you for your assistance in this matter.

                Can you clarify, what do you mean it's not the agreement - did you have several HBOS products? This is for their old dual visa/mastercard I presume, ie 2 cards one shared limit?

                OR do you mean they've sent a recon terms which do not comply, well I can tell you now they're not the same terms you agreed to - that's obvious, but changes nothing (ie it's still unenforceable)....

                If so, what account do 1st Credit presume this is...? If not, then it's simply a recon of terms so you send back this ---> CCA Query - Missing Prescribed Terms

                  Hi,

                  This was a BOS duel credit card application Visa and MasterCard. I handed the MasterCard back after a few years.

                  1st credit has sent my application form and terms and conditions that are
                  from 2008 onwards and not for my application of 1995.

                  In 2009 I received a letter from BOS stating they cannot find my historic terms & conditions.

                  I hope that this makes sense?

                          Hi All,
                          It’s all being quite for a while no collectors hounding me.
                          I have recently though received a letter from a company called Debt Managers Ltd they say that they are acting on behalf of Lowell – (Barclaycard).
                          (Debt Collection Notice) They say that the account has been referred to them and they want immediate contact and repayment.
                          Has anyone had dealings with Debt Managers Ltd also should I contact them by post?
