      Ok, do you think my opinion will change in a day when i've seen the document, confirmed it's a recon/forgery and advised what to send off? It doesn't matter how many ways you describe the sky as being blue, it's still blue.

      Ergo this is a recon, forgery or not, it still complies with s.78 and therefore UNLESS it goes to court stop worrying and send the template as advised above. I don't have the time to repeat myself 100 times. Its simple, send that and if they write back then we'll get nasty - but the last thing you do is write and list all their problems and accuse them of fraud cos if they take it to court magically, you'll find your defence is weak as they remedy your findings.

      Keep these things to yourself until such time they try and take formal action. So send the template above, and update us when you get a response.....

      I know what you're saying, yes it affects things but ONLY if they take things through court, which considering they KNOW they've falsified a document will be rather stoopid of them, you think? However they can falsify documents in line with Carey - they can create a document (using cut/paste) to reflect the original agreement using any form of materials at their disposal, so if you wrote in changing address, they could copy your signature and paste it - this is what i'm ranting over with Garlok, about Carey (or Judge Waksman) - he's made the legal system into a mockery

              Sorry I edited my last post and never quoted doh!!

              Basically the Littlewoods & Barclays are BOTH

              Send same template to for both. So you'll be sending 3 letters to lowells in 3 envelopes ok? All recorded delivery

              ie send application form received for the Morgan stanley and an missing prescribed terms for littlewoods & barclays.

                  Hi,

                  I have just had a letter form The Bank of Scotland (Halifax) informing me that they have sold my alleged debt onto 1st Credit Ltd.

                  I have sent Niddy my alleged CCA from them (Application form)

                  I CCA the Bank of Scotland (Halifax) in January 2009 & they have been total pigs since then. They have sent debt collectors around to my house and completely been aggressive.

                  It’s been so far with
                  • Blair Oliver and Scott
                  • Robinson Way
                  • Iqor
                  • Moorcroft - they sent a field agent to my house with out invite.

                  Now sold to 1st Credit

                  I have updated my thread at the beginning to include this.

                  Can any one offer any opinion or share experiences with 1st Credit

                  As of Lowell’s from my thread - I have not heard much from them as of yet.

                      Hi Free

                      I am also quite new to this but I am a fast learner. My advice on people visiting to supposedly collect debts is simple. You do not have to speak with them at all if you don't want to, unless they are court appointed bailiffs in which case they would arrange a legal visit through the court. It doesn't appear that you are at that stage so just read below.

                      So I suggest sending a copy of this template Threat of Doorstep Visit

                      If you are unlucky to get a visit (I had one) simply tell them you wish for them to leave and that you have nothing to say. If they don't comply then threaten to call the Police. if they are stupid enough to ignore the threat and still will not leave then call the police.

                      I cannot offer specific advice on 1st Credit but I would suggest they are like all the other DCAs of this world. Take advice from NID and his merry crew, NEVER phone them, never speak to them on the phone if they call you. Always correspond in writing and send it Recorded Delivery so you have proof of postage. I was advised to staple my proof of postage to the letter they sent me and that is a very useful tip.

                      Last but by no means least, chill and try not to worry as this will not help at all. The people on here are brilliant and they will help you - hey that even includes me now and I am in a pretty deep hole myself!

                      Good luck - smile and relax - even though I know it's bloody hard at times!

                            Hi,

                            In the past I have sent numerous letters to all these collectors expressing I have no desire for any visits.

                            Moorcroft sent a Field Agent to my home and my partner answered the door, he was liberally discussing my account with her at the door. She told him to go and he left his contact details for me to contact him.

                            I rang him and said why are you at my door as this is in dispute and I expressed to your company that I did not want any visit, he said he was not informed by Moorcroft and he can come if he wished, I said if you come again I will ring the police he said please do.

                              That is just Neanderthal bravado and I would ignore it. He thinks he is being smart but his attitude would change if you quoted the law as he was faced by a police officer. Just ensure you send the template I suggested - DO NOT SIGN IT just type your name and then see what happens. Also ensure your wife never allows them to enter your home no matter how friendly or plausible they seem.
