I suppose I could sign it myself. It's DH account, technically, as my name isn't on it. I could sign DH's name, we write completely different.

As they've already released the CCA to us once, I simply don't understand why this nonsense over the SAR and the signature.

And the odd just keeps coming...

HALIFAX - got a weird letter from Iqor re our Halifax account today. Ramble ramble ramble inanely, then says they feel the problem has been resolved, but they are giving us 2 wks to respond. Of course it hasn't been resolved! And they're saying Halifax was not aware that we were still having an "issue" with the account - um, yes they are, as we made them aware in writing a couple times, directly to them as well as through the numerous DCAs they keep shifting it to. Feel like I'm just going in circles here. Obviously I'm going to have to request SAR from Halifax and see what they have, as the CCA information they sent me was incomplete and their DN was bad as well. Nothing like going over old stuff over and over again. I imagine they'll yank the account back from Iqor soon and send it elsewhere. They did it in the spring with no reason whatsoever (even Iqor admits this).

Not a whole lot to update here, just basics.

Halifax/Iqor - still UE, although they refuse to acknowledge it obviously

Tesco - still no SAR, requested it again

MBNA - still no response to the letter requesting the 3 yrs missing from the SAR

Recently sent them all a letter as DH has been having serious mental health issues, basically requesting they put the account on hold for 60 days, as he is in no condition to make decisions and the accounts are all in his name. They'll probably completely disregard it, but had to do it, as he simply is not able to cope with this right now.

We have a Santander card that we haven't paid on in over a year. When we requested updated information on the account last year, they sent us a statement that said on it that the balance was zero and money to be paid was zero. This is the account that Santander sent us over 15 DNs over the course of about 40 days, along with other post, so we basically got post from them every single day for over 40 days (other than Sunday obviously), and they all had different amounts on them (this happened over a year ago).

Today, we've received a letter from them saying they've turned the account over to Fredrickson International Limited for collection on their behalf, and that we will be hearing from them shortly. So... do we send a copy of this letter showing a zero balance to the DCA once they contact us?

good idea, it also helps if things got to court, ie you're pleading for help here - a judge will take on board the content of such letters so well done....

I will wait until we get a letter from the DCA and send them a copy with a "see attached" letter and go from there then. I will be SO glad when I'm all done dealing with Santander!!

I didn't send this particular account a letter re the mental health problems, as I considered it at "zero balance".. so would have had no reason to send anything to them. I will revisit that when I see what stance they take after sending them the zero balance sheet.

                Thank you.

Yep agreed, good idea - as you owe zero, then why respond?

As expected, letter from DCA re the Santander account arrived yesterday. I will be copying the zero balance letter from Santander and sending it to the DCA first thing Monday morning and then see what develops from there.

Perhaps you should enclose a cheque for that amount, in full and final settlement?

Just put "pp" in front of it.

That's easy to understand: they're playing at Silly Buggers.

When someone sends them a SAR, it means that the alleged debtor has obtained advice and is starting to regain some degree of control. It is only natural, then, for the Data Controller of the OC or DCA to try to ensure they retain full control of the situation and of the data the alleged debtor is permitted to see.

Clever Clogs - well, we've asked them to put it on hold for 60 days due to DH's mental health problems, so I'll wait out the 60 days and provided he is comfortable making decisions at that point, then I will remind them of the fact that the SAR has yet to be sent to us. Obviously I can't push it at the moment, as we've just asked for the account to be placed on hold, and while I can ask repeatedly for it, I don't want them to think it's DH trying to pull a fast one; he really is in no condition to be making financial decisions.

just a quick question... "pp" before the signature? what does that mean?

You must have seen this on letters? Usually secretaries will do it for their boss, so they sign "per procurationem" for someone, ie they "PP" their signature by the other persons name so in your case, it'd be like this:

                              Yours faithfully,

                              Mr Smith

pp Mrs Smith - in your handwriting
ie you have in essence signed the letter on behalf of your hubby.

                              make sense?

Ah, okay. I thought you only did this if you had the "authority" to sign for them. Thanks for that. That's regarding DH's Tesco account, so I will do that when the 60 days is up, after running it by him.

I glanced over the letter Santander sent me, while making copies to send to this new DCA. The actual wording is:

State of the account - the total sum paid £x.xx (specific amount listed, which is over what they are saying is due) and the outstanding balance £0.00.

Total sum which has become payable under the agreement but unpaid by the client: £0.00

It's their response to the "account information" requested when I did the CCA request last year. My letter to the DCA is very very long... it says "Please see attached."
