      Ahh however as DPA comes into play you CANNOT pp a letter to a creditor without first having hubby authorise you with the firm in question so don't do this as they'll reject it based on dpa1998.
      I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website.               Letter received today from the DCA re the Santander account. It says they are placing the account on hold while they check with Santander. So we'll see what happens from here.

                Nothing new re the Santander account. Apparently they are still thinking about it.

                Tesco has sent us an "excellent opportunity" ... if we pay £5K up front, they'll wipe out the rest of the debt. Or if we pay almost £2K per month over the next 3 months, they'll clear out the rest. Otherwise they may sell the debt to a DCA.

                We, of course, are still waiting for a complete and correct CCA, as well as the SAR we requested and paid for. It seems that Wescot is no longer involved, as the letter was directly from Tesco Bank. hmmmmmmm

                    It's been fairly quiet here. Only curious thing is a statement from Tesco loan, which shows a £10 "one off payment received" from the balance in August 2011. This would be the £10 we sent for the SAR, which we STILL haven't received. So I'll be sending them ANOTHER letter asking what precisely the hold up is.

                    I have a suspicion there's some issue in finding the paperwork, as when we queried the PPI 2 years ago, they couldn't locate it then.

                      Hmmm, this also affects SB so they have messed up, you ought to send a copy of the SAR and a copy of the statement confirming the payment was added to the account and literally remind them that they are in direct breach of OFT Guidelines and ICO Guidelines and unless they immediately remove the £10 payment and allocate it towards the SAR and deal with the SAR then you'll complain to the regulators.

                      Give them 14 days to respond.

                      Keep us updated and remember to PM me and nudge me after 14 days as you'll then have follow-up action to deal with

                          Received a "your instalment plan is up for review" regarding our Virgin account from the DCA (we are paying £10 per month). I've just sent a letter stating that our circumstances have not changed financially, so we are unable to change the payment amount and will continue to pay the £10 per month as previously agreed.

                          On a side note, we finally received the rest of the SAR from MBNA, so we will be going over it and sending off the PPI reimbursement request from this (hopefully this week).

                            Oh... dear... lord... give me strength!!!!

                            Tesco have replied.

                            "To ensure we are releasing the account information to the correct party we need to verify your identity so please return a copy of this letter containing a copy of your signature or alternatively could you call us directly on xxxxxxx so we can confirm security."

                            Well, let's see. They've been told REPEATEDLY that we don't want communication by phone (due to DH's mental health and the stress involved). So that leaves the signature... again...

                            When we initially asked for the CCA in 2010, they faffed about for over 8 months demanding a signature, then suddenly coughed up a CCA (without us giving them the signature) that was incorrect (had wrong monetary amounts on it).. then when we initially sent the request for SAR, they demanded signature, then ignored us when we continued to request it.. now they're demanding signature again.

                            That's it. I am going to send it in with ME signing his name (it's in his name only) and my handwriting is miles different than his! They are driving me bonkers.

                                Oh, the temptation. I'm going to have a quick think to see what the most creative (and annoying) would be. I am most curious as to what they will provide (if anything) for SAR, as two years ago when we talked to them on the phone regarding the PPI, we were told they were unable to locate the original paperwork on it.

                                The whole situation is quite a mess, as this is a second loan from them which is a partial rollover loan from a first one, and I suspect we got charged more than we should have regarding the PPI, as they rolled the charges from the first loan into the second. I need the full paperwork from both to sort it out.

                                God, but they are obstructive! grrrr
