    RE: Tesco account. It appears Wescot made a credit search on DH in May, listing reason as "outstanding debt". Is there any particular reason for doing this? We haven't moved, and as we've been responding to letters to Tesco and their various hitmen (DCAs, solicitors), it's not like they didn't know where we were and needed to verify our address on file.
    They do this as a trace - it'll record as an outstanding debt and remain for 2 years, not like a normal credit search which last 1 year...

          Received a letter from Wescot yesterday. They're saying "we believe the dispute has been resolved and the full balance or an agreed monthly instalment is required by return....If in the event you believe you still have a valid dispute, please contact us with the details within the next 14 days otherwise your account will be returned to our recovery team for collection."

          Hmmm..... I'll be honest, I'm tempted to send the £1 to Tesco and say "okay, yeah, whatever, send me what I requested." As I have no clue what they think I've requested. LOL

          Actually, I've debated sending a request for the SAR... I definitely want to find out more re their PPI stuff as well as what precisely they have in the line of paperwork. We paid PPI on this loan. On our PREVIOUS loan with Tesco, their PPI was "no pre-existing medical conditions covered" and they gave us a partial reimbursement. It was really confusing at the time, as that loan had rolled over into a new loan (this one) which obviously took the whole balance left (on which PPI had been paid) and dumped it into the new loan. Then more PPI agreed by DH. When I asked about the PPI on the second loan, I was told (on the phone) that they were having difficulty locating the paperwork on the second loan, but "assured" me that their PPI now covers pre-existing conditions and that regardless of whether or not it was when we took it out, it would cover it now. I'm rather questioning that... (besides regardless, it still would have been mis-sold if it didn't cover it at the time it was taken out!!!).

          Would I be able to send an SAR as well as a request for the PPI terms and conditions at the time the loan was taken out, as well as current ones? Or do I just have to take what I get when I ask for the SAR?

          (Weirdly, they sent two letters in one envelope... dated about a week apart. The first has a typo on it that is circled with ink correction and handwritten above the typo "passed back to op 1-8-11". Why would they send this?? Just mistake? Everything else is the same on it.)

          Do they need a signature for the SAR?? As the letter we got the other day again asked for a signature (for whatever it was we didn't request LOL), and I imagine you remember that it took us 9-10 months to get the CCA due to them demanding signature, which we never sent.

            Hiya

            A sar is about you, the data subject, not accounts. Therefore it will send a copy of EVERYTHING it holds about YOU for at least the last 6 years so you could do multiple PPi reclaims if you have had multiple loans.

            Do not sign it, no. Also send it direct to the OC NOT the DCA. A SAR cannot lawfully dispute a debt, therefore send a separate request for the CCA to Tesco, with the £1 and that will then buy time whilst you await the sar.

            So, what you need to do (abbreviated)...
            1. Send this to Tesco (CCA + £1) CCA Request
            2. Send this to Tesco (SAR + £10) Subject Access (SAR) - Advanced Request
            3. Copy in both above letters to the DCA (Wescot) with a simple cover note saying, see attached - I expect this account to be placed on hold pending the delivery of both sets of documents, which are needed to defend your allegations.
            Send all recorded and DO NOT sign anything! Keep us updated with developments.....

              I've received a letter from Wescot stating they will be sending a doorstep collection agent to our house if we don't phone them immediately. I will make sure to also put in the letter re doorstep collection into Wescot's correspondence.

              So that's where we are with Tesco right now.

                  I'm a bit aggravated with them, actually, as they sent us a letter dated 04-08-11 stating if we still believe we have a valid dispute, please contact them within the next 14 days otherwise the account will be returned to their recovery team for collection. Then, they send us a letter dated 12-08-11 stating they "know of no genuine reason why you have failed to repay the outstanding balance" and will be sending a doorstep collection agent!! So they allowed one week after saying they would allow two for a response. I'm half tempted to send a copy of both letters, with a big red circle around the dates and the "within 14 days" part and tell them that we're not amused at the harassment level.

                      No, but they've done some incredibly obstructive things in the past two years, so I may address it in writing, as if they ever attempt to take us to court, I'm going to keep it in mind for "unfair relationship" stuff. And it was pointed out to me that showing that we attempted to address the issue in writing highlights that a bit. So I may add a paragraph in to the letter. Besides... it makes me feel a bit better to hit back a little, using calm pointed language and big words. Makes me feel like I've returned fire, if that makes sense. I'm tired of them trying to push us around - they pissed around for 9 months refusing to send the CCA for no good reason (well, other than they probably couldn't find it! LOL), so I rather take offence at them pushing the envelope - if you say you're going to wait two weeks for a response, then bloody well WAIT TWO WEEKS FOR A RESPONSE!!!!

                      Can you tell I'm in a rotten mood today? LOL

                          Hi L & C s Mum,

                          Wescot are really a pain and persistent. They will push and push on the letter front and it is all a ploy to get you to call them on the phone. Don't is the simple answer they are experts at trying to trap you.

                          Nelson Guest will be next they are the toothless solicitors they employ. just threatne them with something and they will run.

                                Oh yes, I know they are a pain. I also know they are trying to get DH to ring them. It's not going to happen. I WILL, however, put it in writing (as I'm already sending them a letter) that when they specifically state they will provide two weeks for a response, then I expect them to wait two weeks before they then demand anything. And that if they continue in this manner, I will consider it harassment and act accordingly. They can sniff at it all they like, but I'm basically laying groundwork on this one. They've been dreadful about harassment and being obstructive (everyone associated with the Tesco account). So I will point it out. And then tell them, by the way, there will be NO doorstep collection activity and oh yes, put it on hold as I'm waiting for a CCA request - and as the last one took them 9 months, this could be interesting. LOL (I won't tell them THAT part hahahahaha)

                                Sometimes it just feels nice to push the bully back a little bit.
