        Uh? Where did I say that junk was enforceable? I never!!

        I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

          You're quite right you never did say that. Some stupid DJ (or High Court Fool) in the Carey case did or so some creditors seem to think. They would say that wouldn't they? My apologies.

              Truly truly odd piece of correspondence from Tesco. Saying that they are in receipt of our letter requesting CCA and we need to send the £1 fee and DH's signature. Quite literally, I am sitting here thinking "huh?"

                must admit i spend a lot of time wondering what the hell they are on about, I'd just ignore that for the moment and see if anything else turns up. I think they suggest you send a £1 for a CCA when they can't think of anything else!!!

                  if you are making a formal request pursuant to the Consumer Credit Act then you must send a £1.00 fee.

                  You are not required however to sign the letter , a electronic signature would suffice.

                        Paul - I didn't ask for ANYTHING from Tesco. I sent a template letter to their most recent solicitor basically saying this account is UE. And then I got the letter from Tesco itself saying I needed to pay a fee for CCA request and they needed signature. And then days later I received something from yet a different DCA demanding payment in full. All for the same account.

                        It's not the first time they've done this - in December 2010, we got a letter from one DCA demanding payment in full for the account within 14 days, and then approximately 5 days later, received a letter from a completely different DCA (again, same Tesco account) demanding full payment. The letters were dated 6 days apart, so it's not like it was delayed in postage or anything.

                        But honestly, no clue what's they're thinking now. We haven't ASKED for anything. Simply reminded them that it's UE.

                          Alright. Back to other stuff.

                          RE: Tesco account. It appears Wescot made a credit search on DH in May, listing reason as "outstanding debt". Is there any particular reason for doing this? We haven't moved, and as we've been responding to letters to Tesco and their various hitmen (DCAs, solicitors), it's not like they didn't know where we were and needed to verify our address on file.

                            perhaps they wanted to see how much total debt you have and if anyone else is getting paid so they can decide which template/threat/grovelling letter may have a squeak of a chance to get them something paid?

                              Possibly. Although to be honest the reason the account is so long overdue is because Tesco spent 9 months avoiding sending the CCA due to lack of signature, and then what they sent was UE. LOL

                              I have to admit that it does punch a bit of a hole in their Data Protection argument that they used for not sending the first one, which they then sent after 9 months still with no signature, then Tesco have now demanded ANOTHER signature for a CCA request that I didn't send!! My poor aching head!!

                                Also, checking a few accounts to give myself a break from the Santander one for a minute, I've realised that DH had PPI on his MBNA account (which he had since 2001!) which I'm willing to bet has been mis-sold. According to him he has NEVER been asked about pre-existing medical conditions. So I guess the SAR letter will have to go off to MBNA. The account itself is currently with Experto Credite (paying £10 per month on it), however, they bought the account, so the PPI reimbursement request will be entirely separate. It will be interesting to see what the amount will be, as for awhile there we were easily paying £65 per month for PPI (back in 2008 before DH cancelled it!).
