    I'm in agreement with Spud, just ignore that letter for now and let us know when they write to you again. If those cards are in your sole name they certainly shouldn't even be asking for your OH's I & E!! Like Spud says, you're under no obligation to provide I&Es except where requested by a court but they can sometimes help.

    It is possible to blag enforceable accounts. I did with two (though pre2007) and they are now both SB.

      Hi Pixie, thanks for this. We do have our own house with mortgage so does this affect things? I still feel that I was slightly pushed into accepting this card, though at the end of the day it was my decision. But, at the time, I had no source of income and still don't yet mbna were happy to go ahead. They never asked for evidence of income and I couldn't have provided it anyway. I guess that was how banks operated and they couldn't do it now without proof of ability to repay.

          I uploaded the complete Halifax agreement a few weeks ago but haven't heard whether it is enforceable or not. Today I received a letter from Halifax saying that the debt has been passed to debt collector Moorcroft. What should I do next?

          I'm feeling very anxious as I've never had to deal with a debt collector. I have no income and depend entirely on my husband for everything but he too has had to stop paying debts as we were living entirely off credit cards. At the time my credit cards were issued I was not working and had no source of income so does this have any impact? Any help and advice greatly appreciated.

            Hi Charlee

            did you email the agreement to niddy?

            I am in a similar position to you. My only income is carers allowance. I also own my home with my husband. Dealing with moorcroft is easier than dealing with Halifax.

            I would wait and see what you get next and post here. Don't let it worry you.

              Hi JLC - thank you for your response and support. I uploaded the agreement in the required way but also emailed It to Niddy and still awaiting a response. I know he may be busy and I really appreciate the help I've received from him and others so far. Trying not to worry but easier said than done so thanks again for your support.

                JLC is quite right, early in the proceedings for you, I would just ignore the letters for the moment but keep letting us know when you get a new letter. The thing is not to speak to these people, don't fill in any forms and essentially don't tell them anything. It is difficult in the beginning, but like Pixie we also blagged quite a few enforceable debts and all of ours are now SB. Please remember that if you don't have it, they can't have it!!!! and credit cards are a long way down the list of urgent!

                  I worried a lot in the beginning. I'm nearly a year in now and things have changed a lot. Email it again to niddy for a gentle nudge.

                    Until I decided to deal with my debts (I too was basically living off credit cards) I had no encounters at all with DCAs. Now I'm quite an expert on them! Some are easy to deal with, some not so easy. Moorcroft come into the easy group

                    The only difference that having your own house has is that they may apply for a charging order but that's a long long way down the line and may never happen so not worth bothering about at this stage. Just keep posting up when you receive any letters etc.

                        Try not to worry. They do bark a lot and if they get arsey then we're here to help.

                        Regards Halifax, you redacted it so I couldn't do anything. If you email an unedited copy I'll look at it as I don't retain historic emails so won't have the last one you sent. If for any reason I don't reply within a few days (3/4 days) please remind me by email or PM here as it could be lost in transmission / blocked by spam filter / missed by me so always chase me if you've emailed anything.

                        Regards the enforceable agreements, if you're being hassled then send a missing PT's template which will buy a few extra weeks peace and make the DCA rethink if it's UE after all. Always best to stay quiet after doing a CCA Request, regardless if it's EN or UE as a lot of DCA letters are system generated so you could get months of peace n quiet if you play the game right.

                                Halifax Credit Card now being dealt with by Moorcroft.

                                Help needed please. Letter from Moorcroft dated 28th November received 5th December (yesterday) telling me I need to pay £8545 within 7 days or contact them by phone or letter with a payment offer. I'm awaiting a reply from Niddy to say whether the CCA is enforceable. Can anyone advise on how I should respond please as the deadline has already passed.
