    I know, thus i'm trying to establish if it was a recon or whether it was like someone elses agreement totally? If it was a recon, this is perfectly acceptable so long as the cover letter says "find attached a reconstituted copy...."
    The covering letter says 'Please find a copy of your credit agreement sent to you at the time of you opening your account'. The covering letter also says i opened the account in 2010(!) but the day and month are correct if it was 1999. They are utterly confused! They actually quote a date which is wrong by 11 years exactly and is different to the cca they sent me!! You couldnt make it up.

    Now the details on it are correct, ie its my name but not my handwriting. Between me, you and the gate post i think the wife has signed for something she ordered later on into the account and done my signature in her handwriting. They are then passing this off as the agreement as they only sent generic and current t&c. She says she cant remember though. Either way, i didnt sign it and they are about eight years out!

    God only knows if this makes any sense, i do apolgise lol.

    The balance is 1500 ish

      I know exactly what you mean, this is obviously and you ought to treat it as such, and stop paying/talking and anything with them - in fact, sod em!

      The amount just isn't worth pursuing, i'd just ignore them to be fair... see what happens in time.

        I think you are right, let them default me etc.

        I did consider perhaps doing the missus for fraud but thought that in the end it probably wasnt worth the hassle and grief lol. Using my signature indeed haha

        PS: if the good lady does ever read this then i am joking ;-)

          Haha - you're dead mate!

          Seriously, to get "out of this" you'd have to tell them the above and let them risk charges, however I suspect their risk dept would consider this a write off as opposed to fraud as it's not worth the risk of investigation (plus the associated costs).....Not suggesting you try and grass the Mrs up like - far from it

            ...... and at the same time they would then have to see its not the agreement i signed when i opened the account lol.

            Why they wouldnt accept my offer of 25 quid a month i do not know, i genuinely perfer to pay off my debts if possible.

              I'd let it run, why pay something you can "prove" was not taken out by yourself? However if they get snotty then wait till they sell it then offer like 20% to clear it, that usually works with catalogue debts that get sold on (cos they are usually low value)...

                Oh well, no response to my complaint (not that i really expected any) but i have received two letters containing default notices and giving me plenty of time to comply. Not sure why they have split it into two, one is headed 'running account' and the other for 'fixed terms' or some such. The account number remains the same on both of them.

                File under ignore i guess until a dca crawls out.

                  What type of account was it - it can't be both so worth checking

                  Just ignore for now but write the date of receipt on the envelope and confirm what account this relates to ie the type of account.

                    Hello all

                    Update for my MBNA account with two new letters arriving today!

                    The first is my default notice which is no suprise but the other one is a copy of the one they already sent me saying they cant currently comply with my request for a cca so wont enforce in court while this is ongoing etc. But i still have an obligation to pay

                    Not quite sure why they sent that one again.

                        Hi all, generally quiet on my fronts but could do with some advice if anyone has the knowledge. Both my mbna and kays were defaulted in may at about the same time but upto now i have heard nothing from either. I though it would check my credit file online and sure enough, mbna has a nice fat 'D' against me. But Kays/Shop direct havent. It says still open even though they said it would default on may xxth. Not sure whats going on, there is a 'Q' on my account up until may but nothing for june or july. It actually says this account was last updated on the 5th of july!

                        Quite bizarre. Any clues why my file hasnt been marked yet? I am just anxious that the 6 year clock starts ticking as soon possible.

                            I guess i was thinking along the lines that someone may enter a default on my file way down the line. But like you say, stat barred is from the last payment. Guess i am just twitchy wondering when the letters will come lol
