    Ermmm, hello - why the hell did you pay this? if a guarantor loan was not guaranteed then it'd not be valid! Anyway, hindsight eh?

    We have loads of spank smileys......

            Ok, well don't be thinking for too long... it's not going to go away! But whatever you do, make the right choices - even if thats to try and make silly offers, just to see that they will not accept things that low - it would ease your mind, but also allow them to know you have money - which we don't want

              Hi Nids, so Moorcroft and Cabot have forced my hand to start taking a look at things again!

              I have updated the relevant posts (7 and 8). Have some paperwork to look at and have emailed the scan to you for when you have time if OK? Looks like my application form, plus a set of "conditions of use" that seem generic.

              Also Moorcroft have sent a letter acknowledging receipt of a £1 payment. So they have used it towards the balance rather than for CCA request. Is there a template letter to reply back to this?

                  Don't worry about this; they are in default of your CCA Request so give them a month or so then send off the CCA Reminder - if they have offset it against a debt then it's their fault, they cannot enforce this until such time they respond with the CCA and fully adhere to your s.78 request.

                  therefore this is, and remains, until such time they come out of default.

                  No action necessary on this for the time being

                      I received letter from Cabot Financial for Sainsburys (dated 6th May) stating that the paperwork they sent me was indeed a signed copy of my original credit agreement; again they're still referring to the application form.

                      Do I just send the
                      Refusal by Lender/DCA - to accept Unenforceability letter?

                          Hi Niddy, I'm still lurking! I haven't made any offers just sitting tight on everything.

                          I just wondered if there are routes I can go down for a defaulted bank account (Santander) - I know you can't really go for unenforceability but is there anything else I can try? They added masses of charges so total is way over.

                          I have updated that post and haven't responded to anything they've sent me yet.

                            Just see what happens, for the moment just ignore Santander.....

                            HSBC is a right pain.... the FOS have thrown away my complaint, I sent it special, have receipt etc and they (FOS) say it isn't there. Joke!

                                It was a 200+ page dossier I posted that was £14 in postage. Not impressed, not at all.
