    Not heard from Hillesden for a while, but the solicitor contacted us on their behalf the other day with a copy of a CCA, and income and expenditure forms to provide proposals for payment.

    Demanding response within 7 days.

      Has Niddy see the CCA ?

              um, might be worth giving it another day and then dropping him a PM just to remind him mate. He is a busy chap.

I am now saving the money each month that was making little difference to the balance and not a bit of difference to my credit file as a result of finding AAD.

                It's only been 3 days....If you've not hard anything by weekend give him a quick PM....

                  OK. Thanks. The letter from sols said I had to respond within 7 days and knowing the firm involved i feel nervous not responding to them with something.

                  Any suggestions?

                      Niddy says its enforceable.

                      The solicitors have threatened action if we dont make an offer for repayment by installments - and want this supported by income and expenditure forms, backed up with bank statements and pay slips).

                      What's the best way to proceed?

                      Can we ask them for proof that they have a right to collect the debt?

                      Do we have to provide income and expenditure forms, and details of our pay slips and bank statements?

                      Are we obilgated to provide this (if we do I'll use the one suggested by the CCCS)?

                        Sorry to be a pest on this, but while the solicitor for the DCA has provided a copy of a CCA (which Niddy says it is enforceable) I haven't received a statement of account as per my CCA request, and there was nothing in the documentation from the Solicitor that provides any indication of their client's right to enforce the CCA (i.e. that they bought the agreement from the original lender).

                        Should I write and remind the DCA/solicitor of this ommission to the CCA request?

                                Hiya

                                Really sorry for the delay, been really busy.

                                Ok I would for now send this off --> CCA Query - Missing Prescribed Terms - allaboutDEBT UK

                                See what that does, send it to whoever is hassling you (ie whoever sent the CCA to you last month). Sod paying just yet, you can do that if they do indeed start action but for now, see what happens.
