    I would try looking in your own information first.

    Try and think if you paid them anything after the Default was received and how long before the default you last paid them.

    If you cannt remember or find that information, a SAR should show it up, but a little early for that at this stage. See what you can find first,

      I have no information at all such as statements. When I ran away from all this I did it properly as in everything got disposed of. I know it was at least 3 months that I made no payments before the defaults happened so it may be getting very close indeed. Is a SAR the thing to do to get copies of statements?

        Looking at another account that has a default it has info on equifax showing 3 months of records, ie 1 payment late, 2 payments late, three payments late and then default.

        The one that Arrow Global are after only has one red square that says default and it is in April 2007 so by my reckoning the last payment would have been January 2007.

        Looks promising, yes???

          If you are absolutely certain of that, then this will either be SB already or right on the edge.

          In post #2 on the first page, you said that on 19/10/12 you were sent “CCA, Terms and conditions and statements”. Did those statements not give you any idea of when you last paid?

            The statement that was sent was dated 2010 and had my current address on it but I haven't made a payment since well before then. When they (Arrow Global) sent me the statement it was the first time I'd seen it as I've had no contact whatsoever with RBS since before the default. Think it may be worth the investment of £10 in a SAR????

              Well a SAR is the only sure way of getting your statements.

              But if you are sure you have made no payments since the default, then you are just about there.

              Post again when you get further communications from the DCA

                Did that statement received in 2010 allege that you made a payment around that time, or was it just a statement which showed the same balance in and out?

                  Hi SH,

                  It's a statement that show the same amount in and out and tells me that I haven't made the payment on time so they will start action.

                  This was the first trace of any paperwork from RBS since the default.

                      If I was in this situation, the first thing I would do is send an SAR to RBOS, the original creditor. It is just so important to establish when the statute barring date actually is. Without this, Arrow could litigate, and you wouldn't know whether or not you could use Limitation as a valid defence.

                      You could also be opening yourself up to several months of unnecessary letter ping-pong, which could easily end up costing more than the £10. If you can prove something is statute barred, they should just disappear and leave you alone.

                      There is something about this whole situation which doesn't add up. The isolated statement from 2010 and the “Letter sent disputing validity of details received as agreement started before 2007”, which happened just before you joined this site. I'm wondering whether paperwork might not have got mixed up somewhere? I think the results of an SAR might at least throw some light on the situation.

                      As for CPUTR, that is certainly a possibility worth considering. Their last letter just says that they “believe the agreement complies with the statute”. Anyone can say that about anything. What they “believe”, or claim to believe, has no relevance.

                      The basic strategy I would follow is to pursue a UE route, while waiting on the information which would tell me when limitation would kick in and end the game.

                        Thanks for that SH,

                        I have sent the SAR off to RBS just now. I see on the SAR template that it asks for info on all accounts invloving me that they have so will I be correct in assuming that I'll get back all the statements for the current account I have with them that is also in default?

                            Have had a reply from RBS asking for a signature, will reply with the Signature Request by Creditor Template.

                            Just seen the appropriate item in the template list

                                A week or two ago I had another letter from the SAR team at RBS saying that although the legislation doesn't require a signature it is THEIR policy to require a signature and they included a load of bumf to get me to part with one.

                                I roundly ignored the letter.

                                Today the RBS credit card debt of £2,800 odd has dropped off my noddle report...

                                Thanks to all for the advice so far, if this continues then everything will be gone in another 3 months.
