    It may also be RBS policy for their investment bankers to skip around the office naked at midnight with ribbons clamped to their nipples, doesn't absolve them of what is actually legislation!

    A week or two ago I had another letter from the SAR team at RBS saying that although the legislation doesn't require a signature it is THEIR policy to require a signature and they included a load of bumf to get me to part with one.

    I roundly ignored the letter.

    Today the RBS credit card debt of £2,800 odd has dropped off my noddle report...

    Have had a reply from RBS asking for a signature, will reply with the Signature Request by Creditor Template.

    Just seen the appropriate item in the template list

    Thanks for that SH,

    I have sent the SAR off to RBS just now. I see on the SAR template that it asks for info on all accounts invloving me that they have so will I be correct in assuming that I'll get back all the statements for the current account I have with them that is also in default?

    If I was in this situation, the first thing I would do is send an SAR to RBOS, the original creditor. It is just so important to establish when the statute barring date actually is. Without this, Arrow could litigate, and you wouldn't know whether or not you could use Limitation as a valid defence.

    You could also be opening yourself up to several months of unnecessary letter ping-pong, which could easily end up costing more than the £10. If you can prove something is statute barred, they should just disappear and leave you alone.

    There is something about this whole situation which doesn't add up. The isolated statement from 2010 and the “Letter sent disputing validity of details received as agreement started before 2007”, which happened just before you joined this site. I'm wondering whether paperwork might not have got mixed up somewhere? I think the results of an SAR might at least throw some light on the situation.

    As for CPUTR, that is certainly a possibility worth considering. Their last letter just says that they “believe the agreement complies with the statute”. Anyone can say that about anything. What they “believe”, or claim to believe, has no relevance.

    The basic strategy I would follow is to pursue a UE route, while waiting on the information which would tell me when limitation would kick in and end the game.

    Hi SH,

    It's a statement that show the same amount in and out and tells me that I haven't made the payment on time so they will start action.

    This was the first trace of any paperwork from RBS since the default.
