        Ok, so say that this is enforcable, what are the steps available to me to delay the process as this will be statute barred in early April 2013...

          just send off the letter that Niddy advised above, you treat it like it is UE, sometimes they are so thick, they begin to believe it too..............

            Yes I have...so far.

            Sent cca requests mid 2010 and hadn't heard from either of them since March 2011 but one's just reared it's head again.

            By what for do you mean the amounts of the debt? One debt is around £3K and the other £1400.

            Just do as MrsD suggested and treat it as UE..you haven't got long to go...

              The letter went in the post today, just got a bit panicky there when Niddy said it may be enforcable, but as I always tell my wife, no point panicking until there is something to panic about and even then, panicking is always best done slowly!

                  Also to prolong "their agony" any letters they send back to you saying they are giving you 10 or 14 days till this, that, or the other is going to happen or collection activities are suspended for 14 days, or they give you a specific date I'd wait closer to the date they are stipulating before sending a letter of response back. In other words don't be too hasty in sending a reply back when you have got a bit of a breathing space and all the while the clock is ticking and getting closer to April 2013 (SB time).

                  Of course if anything important needs sending back to them then you need to deal with it appropriately.

                  I have an account with MBNA which is deemed enforceable but I've been blagging some time now and not heard from them since June 2012 (Account 4 on my diary) so you should be OK. (fingers crossed)

                    Hi and welcome.

                    Just drag it out as much as you can. I have waited until the 'deadline' stated in DCA letters has just passed by a day or two before posting a reply.

                    When you start spouting UE stuff the DCAs go on the backfoot as they realise you're not going to be a pushover. Presumably you're not talking to them on the phone and that also weakens them.

                      Hi all,

                      I had a reply from ARROW GLOBAL to the UE letter saying
                      We refer to your recent letter, the contents of which has been noted.

                      We have previously provided a copy of the credit agreement that was signed by you at the time of the inception and believe the agreement complies with the statute.

                      We intend to pursue payment of the debt and now look forward to receiving your payment proposals.
                      Is this a regular thing, are they trying to get me to forget everything that has happened so far and just send them money or would this be a precursor to action?

                        It seems to be a common ploy that the OC/DCA claim that they have complied with CCA74, hoping that you will now pay up. They may or may not have complied, but the question is whether the agreement is Enforceable in court.

                        Go by what Niddy says re whether or not it's UE, and decide on your strategy for continuing to fight the cause. It's not necessarily all over by a long way.

                          So now do I send them another letter, one of the final responses from the template section or wait for something else to show up?

                          Don't worry I'm in no hurry to get back to them but fore-warned is fore-armed and all that!

                              Statute Barred will run from the last time you made a payment or the last time you acknowledged the Debt, not from the time of default.

                              It is quite important to try and pinpoint the last payment. If it was before the default, you may already be there.
