      NatWest have responded... usual sort of stuff. They reckon they have met their statutory requirements by providing a "true copy" of the agreement relevant to the card ... plus a copy of the terms of the card product (They actually sent 4 sets of Ts and Cs, obviously to make sure!!).

      In short they don't consider it's in dispute, and they advise to seek advice from CAB or similar... Let me think, CAB? no I'll go and see Niddy instead

      I presume that there is no response needed and we just sit tight and wait to see which DCA tackles this next?

                Goooood evening

                Very very long time no see.

                Things have been fairly quiet. Only one default left on the credit file.

                This was my first post from way back then..


                1.Credit card - Barclays
                2.Start date - 05/07/2004
                3.£2234
                4.Date last paid - July 2009
                5.Are you on arrangement or not paying - Not paying (stopped agreement payment of £15 Dec 2010)
                6.Status - arrangement to pay - now cancelled (wife told me to)
                7.Account owner - TBA.

                Jan '11 Barclaycard say they are looking into his request and will come back to him.


                It's since been passed from pillar to post, and followed by a series of Account Sold letters. I have never received the CCA from Barclaycard.

                Today have received out of the blue a letter from Howard Cohen, Notice of Pending Legal Action giving 10 days' notice. It's dated more than 10 days ago but the envelope has no postmark. Will send the LBA letter first class recorded tomorrow.

                  I've now received a threat of legal action (see post above) but hoping that a LBA will see them off.

                    It looks as if you've got a CCA Request outstanding from Barclaycard in 2011 so that should help you if Howard Cohen decide to pounce. Have you kept the Barclaycard letter saying they can't find your CCA?

                    Don't send a new CCA Request.

                    Do send the LBA Response letter

                        Barclaycard never said they couldn't find a CCA, they just never sent it! It got sold on and passed around.

                        Don't worry, will not be sending any further CCA request, just the LBA letter.

                              So have you kept any paperwork which will prove you sent a CCA request in 2011 and any response from Barclaycard at the time which acknowledges your s.78 CCA Request but also says "still looking" or summat like that?

                              If not then you'd be wise to send a SAR to Barclaycard to get your file asap.

                              Howard Cohen just can't resist issuing claims.

                                Yes still have a copy of the original CCA request sent off in late 2010... and somewhere (it's in a file but I know where the file is) the letter from Barclaycard saying they are investigating. Never had anything further from Barclaycard with a CCA, just heard from a series of DCAs sending threats.
