    (Nov 17) - Letter received from Restons Solicitors, of their having been instructed to issue court proceedings.

    (Dec 17) - Due to advice at the time from another forum, I ticked box (letter I "I need more documents or information") and requested I be sent 1) a copy of the contract, including all items and conditions, 2) A list of all transactions, showing how the ~£9750 figure was calculated, 3) copies of any notices of assignment, 4) copies of any relevant deeds of assignment and 5) a copy of the default notice. I also sent a CCA request to Arrow Global Limited separately, while advising of my new address.

    It seems ALL that you have received are the CCA documents from Arrow Global Limited.

    Nothing it seems was forth coming from Restons. Well can Drydensfairfax fare any better?
    It seems you haven't seen a copy of the any of the requested documents including a default notice?

    The Letter Before Claim if issued eats up a further 30 days doesn't it towards that November deadline.
    I would wait and see what they send next and then post up here!

      Yes send a SAR to Halifax so you can see what's been going on behind the scenes - there may be something noted in the log which gives you a clue as to why Restons Solicitors didn't issue legal proceedings after their 'Letter of Claim' in December 2017, especially since Arrow sent you documentation at the time.

      I don't think you need to do anything else at the moment as your aim is to get to Statute Barred status before any claim is issued.

      If DrydensFairfax do send you a 'Letter of Claim' you will have 30 days to reply so post on the forum for guidance on your next step then. At the moment they're only threatening to send you a threatening letter

        SAR submitted to Halifax (Lloyds Banking Group).

          No 1 - HALIFAX / ARROW GLOBAL LIMITED

          Hi all,

          Today I received a Letter of Claim from Drydens Fairfax, along with an income and expenditure form and account balance sheet.

          I'm assuming that I should either tick box D (I dispute the debt) or box I (I need more documents or documentation).

          If ticking box I, this would be the second time I have done so, along with requesting information, some of which was provided by Arrow Global in the past.

          I'm still waiting to receive a response back from my SAR request to Halifax / Lloyd's Banking Group.

          PlanB it would be great if you could help. I'm happy to attach the documentation here.

            Before deciding which Box to tick let me take a look back through the history of this debt, but to speed things up can you just confirm whether you've been sent any new documentation since the last Letter of Claim?

            From memory the previous Letter of Claim was sent by Restons Solicitors in 2017.

            No need to post any documents on the forum which could identify you - you can never be too careful!

            You have 30 days to deal with this so take time to do some research before replying.

              hey Di.

              That is correct. After the letter of claim in 2017 I received a copy of the agreement (seems to be reconstituted although appears accurate), t&c's along with various statements, but nothing from Arrow Global since then, other than some statements and more recently a letter advising that management was being transferred to drydensfairfax.

              I am still waiting on Lloyd's/Halifax to respond to a SAR, submitted on 9th April, so almost a month ago. Strangely, I didn't receive a notification at the time, either by email or text message that my request had been received. I'm not sure how to proceed, as seemingly no easy way to follow up on this pending request (can't find a relevant contact number or email). Will be good to check the log when received, to see if anything revealing there.

              I'm still within the 30 days since receiving the recent Letter of Claim, but won't be long until that period expires.

                I can't see any specific reference to this clause. The only thing I can see in the T&C's Arrow have sent is the following

                    Credit agreements often ‘appear’ to be accurate on face value but may not be.

                    I’ve seen endless Halifax Credit agreements which ‘appear’ to have everything needed except the total number of pages (usually 11) are missing with only 3 produced etc.

                    Resend what you received to Niddy.

                    When does the Letter of Claim’s 30 days expire?

                      Letter of Claim 30 day period expires on 19th May.

                        Can you please look at this - I've seen the terms but it's pretty clear they've attached a second variant later - the original terms are UE (they stop at 10 then it's tick in the box) but the varied terms continue to term 20 odd.

                                Update for clarity - currently chatting on email with solicitor / original poster (OP).

                                OP will update when we establish the facts, now Jo is looking at it also. Claim needs to be dealt with - have requested copy via email.
