    27.11.12 formal notice of potential doorstep recovery, no acknowledgement of my CCA request.
    Hi Guys, letter from RMA "Notice of potential threat of doorstep recovery" they say they will ask Scotcall to visit if I don't make contact or pay in full. Shall I send the doorstep template? cheers Pez

        I would send it together with the CCA reminder letter. No harm in letting them know exactly why their letter is entirely inappropriate.

        EDIT - Back home now, so here is CCA reminder template -

        Our Templates | Unenforceability Templates | CCA Reminder - Unenforceability Threat

        You'll need to amend the bottom paragraph slightly, as it look as though you've already stopped paying. This one and the harassment template are short enough to merge into one letter with just a distinct paragraph heading.

          RMA had them running after 2 letters, years ago, they were not fast enough for the Olympics. lol

                  Pez, Scotcall are easy to see off, doorstep letter to them asap.

                  As for sending a reminder letter I always thought that once you sent a cca request you didn't bother to remind them just in case they had forgotten. Took amex a long time to send me my UE CCA

                    For newbies this isnt so clear that you should not.

                    Must admit I sent the second letter but did so because I like the idea you have told them its in dispute whereas the first just says what may happen.

                    I like the idea you have a account in dispute letter signed for.

                      The reminder letter is usually sent in response to the DCA failing to acknowledge the CCA request, and continuing to press for payment, as in this instance, not to jog their memories if they've gone quiet

                            That is what I would do.

                            It seems as though Sharklaycard have now run out of arguments, so they are now going to go through the pantomime of making endless equitable assignments. It is a common enough scenario, and is a positive sign overall.

                              20.09.12 recieved agreement and conditions, emailed Niddy 2 docs.
                              23.09.12 Niddy says UE and to send missing PT Template, sent 24.09.12
                              16.10.12 Letter received stating they have fulfilled their obligation and will not release from obligation
                              05.11.12 Sent SAR request.
                              08.11.12 received default sums letter
                              17.11.12 received letter in response to my SAR request with copy of UE agreement - UE conditions and 6 pages of accounting showing every payment and all interest and charges since inception of the loan.This is exactly what they sent in response to my CCA request.
                              22.11.12 Sent Final Response SAR request
                              03.12.12 Letter received stating "We have provided your loan agreement on 3 occasions and have complied with a subject access request fully complying with our obligations. Income and expenditure form enclosed, please complete and send back within 30 days.
                              Hi Guys, letter received as above. Paracrap also state loan now at £20,270.09p. Should be £1600. Interest being charged is 18.330% with £31.80 arrears. They are totally ignoring my letter and requests for information. What are you thoughts on this. There should be so much information on this account from the year 2000 when they wrote to me most weeks, they also corresponded with DMC Alexander Rose (now defunct)There will also be letters from them offering reduced payments and telephone records freezing interest. Any ideas what to do now, many thanks Pez

                                This lot are obviously completely nuts, and they are going to keep living in their own fairy tale world for as long as this alleged debt endures.

                                Obviously, they have no right to income and expenditure information, so that should be ignored.

                                It is now time for a complaint to be forwarded to the Information Commissioner's Office. They are utterly useless and are unlikely to take any action, but I take the position that any Financial Ombudsman Service adjudicator will expect you to have complained to the relevant authorities, and are more likely to take your case seriously if you do. This complaint is purely about their failure to comply with the Data Protection Act.

                                A formal complaint will also need to be sent to Paragoon, so that it can then be escalated to the FOS. This should include absolutely everything which is relevant, from non-compliance with the SAR through extortionate interest being added to charges being made where there is no contractual stipulation for them. The FOS are not prepared to consider the unenforceability issue, but this continues to work in the background ensuring that Paragoon will never be paid another penny unless they are prepared to risk a court claim.

                                They are just total idiots, and now need to be reported as such.
