Keep that letter very safe! I'm scanning and keeping a copy of mine on disk at home and in the cloud too for such delights!

Hi everyone - Had a few loans and credit cards during my life and did not see a problem with spending, working and playing, in 1998 developed a heart condition and had time in hospital and convalescence. Got behind and tried to sort it via DMC who promised the world and produced nothing. Have been paying back for last 12yrs only to find Paragon have been charging interest and not informing me until they had to in 2009 when the CCA74 was updated.They agreed vebally that interest would be frozen in 2000 and agreed in writing that no areers would be added if I sighned an new DD for the new amount. Now in an impossible position re paying back and receiving all sort of phone calls asking for more money and income and expenditure forms etc etc, health poor and concerned about leaving my wife with all this crap. Feel I have hope now I have found this site and have had support from lots of you for which I am very grateful. Below is some of the debts and I will update with the others as and when. 17.11.12 received letter in response to my SAR request with copy of UE agreement - UE conditions and 6 pages of accounting showing every payment and all interest and charges since inception of the loan.This is exactly what they sent in response to my CCA request.
22.11.12 Sent Final Response SAR request
03.12.12 Letter received stating "We have provided your loan agreement on 3 occasions and have complied with a subject access request fully complying with our obligations. Income and expenditure form enclosed, please complete and send back within 30 days.
04.12.12 Sent ICO complaint
18.12.12 Letter received from Paracrap stating arrears have increased to £42.40, they have charged me £10 to tell me this.
18.12.12 Letter recieved from ICO telling me they have received my letter and will deal with it asap
03.01.13 Income and exp form received from Paracrap, no other comments other than "please complete"
04.01.13 Letter recieved from Paracrap: "You did not return your I&E form Please reply within 7 days or phone us. We have charged you £10 for this letter".
04.02.13 Letters received from Paracrap, one default sums notice stating £20 has been added to account and one stating no payment plan in place please contact.
04.03.13 Another default sums notice of £20 added to account.
05.03.13 Letter stating they have responded to my CCA and SAR request. Request I&E to be filled in as they are willing to work with me to sort out a mutually acceptable arrangement. Nothing mutual about their arrangement!

Hi Guys, have just received a letter from Paracrap together with what can be described as a rain forest of crap.They state "Having received a letter from the ICO they have reviewed the issues raised and have enclosed copies of all telephone transcripts and copies of correspondence issues" They go back to 1998 and have listed what they say are all the calls and letters sent. They have obviously edited these as in 1999 they acknowledge I asked if interest was being incurred but have failed to list their response. They have also sent letters from that time but failed to include any correspondence from Sally Bennett or David Newcombe that relate to the interest being frozen or a new DD being set up for the reduced amount. I still have a copy of letter from David Newcombe and Sally Bennet that they have failed to send, unfortunatly only the one from David states that "there will be no arrears added if I set up a DD for the new amount" he also strongly advises I agree to this for the smooth running of the account. They have not sent any new CCA at all. They have sent all the letters that they have sent recently but nothing else. Just wondered what to do next, Niddy says it is UE, cheers pez

I've got three PCs on now, one of them connected to the turntable which is playing pre-1920 gramophone records to create the digital files, one of the others is running Audacity and Izotope RX2 audio clean up software to create a listenable final result, and the other has got three windows open trying to cope with everything I have to do on the Internet.

I agree women are better at multi-tasking in offices, though. They can paint their nails and rabbit at the same time.

At this stage I would just ignore Paracrap completely, unless they issued a Letter Before Action or threatened doorstep harassment. They have sent so much utter drivel that it really is not worth arguing with them right now.

In the near future, a formal complaint incorporating a request under the Consumer Protection from Unfair Trading Regulations 2008 for information regarding the agreement may be a possibility. This could incorporate a request for information concerning the contractual provision for these insane charges they keep adding, which, of course, does not exist.

I would just go back to the ICO and tell them that Paracrap have not complied with your SAR, and that important documents have deliberately been omitted. If you know of documents which should be there, but aren't, mention them specifically.

Thanks SH, will do. Yes there are several letters I have copies of relating to 1999 & 2000 from David Newcombe and Sally Bennett that have not been sent, unfortunately the ones I have only refer to "no arrears been added" and "they will contact me if these arrangement change" and "we stronly recomend you sign the new D/D for the new agreed amount",none of which they have sent. They also refer in the telephone notes that I asked if interest was being added but failed to put in their reply. Cheers Pez

Hi again SH, just noticed that in the telephone transcribe they actually say that the account is in my name only, the copy CCA that has been sent has my wife signature on it as well, albeit half inch above the signature line, no other info about her apart from a copied sig, she never signed anything. Good, keep quiet about that for now but make a note of it, as it gives you another point of dispute for the future.
