Hi jon1965, the original owners were Universal Credit but Paragon bought them out in 1999. The debt was not sold on it was purchased with the company. Cheers Pez

This appears to be their style of working, there are several reports on the internet (Paragon Hell) re their lack of transparency in their dealings., they give telephone promises and lure people into a false sense of security and let loans build up for years then they pounce and demand payment. They let mine go on for nearly 12yrs adding interest all the time but not notifying me of this until 2009 turning a £1800 debt into £22,000 plus. Should be illegal. They need taking down a peg or two, they have ruined so many peoples lives. Pez

Well hopefully they will never take any action because they know what they have done is wrong AND the agreement is :UE . If they did try anything I am sure that for that amount Paul&Co would swing into action if you so wanted.
          Take care

              Dear so and so

              Subject access request

Further to my letter of 05.11.12 in which I made a subject access request, I would now like you to revisit the way you handled my request.

If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).
Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge. I also require that you forward, within the time scale, a true legible copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.

I received a response from you on 15.11.12 from. I have attached a copy of both letters for your information. From the information you have provided and from my reading of the Information Commissioner’s Office website at Data Protection and Freedom of Information advice - ICO
, I suspect you have failed to disclose all the relevant information I requested.

I believe that I have not received all the data I am entitled to. I expected to receive any personal data relating to me that may be contained within the following: All communication between yourselves and Alexander Rose DMC, details of telephone conversation between your staff and myself especially Sally Bennett who I spoke to on 14.01.2000, and David Newcome who communicated with me on 15.02.2000 together with other members of your staff who have had dealing with this account over the past 12yrs.

I hereby request that you supply me with any and all historical data in your possession that relate to my personal file.
If you have withheld any information relating to me I require you to confirm this and tell me why you consider it appropriate to do so. If there is anything further you can do to resolve this matter, or further information you can provide, please do so.

As the statutory time limit for responding to my subject access request expires on 25.12.12 and given this is Christmas day I hereby give you until 05.01.2013 to provide me with this information or inform me as to why you are refusing to do so.

I must advise you that if I do not receive a satisfactory response from you, I will submit a ‘request for assessment’ to the Information Commissioner’s Office (ICO).

You can find advice on the ICO’s website on how to deal with a subject access request [ico.gov.uk/sar] and information on their powers and the action they can take [ico.gov.uk/action] or call them on 0303 123 1113.
              Yours sincerely

Hi Sorry yes, this is the account that should be £1800 but they have added interest over the past 12yrs even though they told me they had frozen interest so the amount is now £22,000 plus.I requested CCA and they sent illegible copy (Niddy says UE) Sent missing PT and they have sent letter saying "we have responded to your request and the matter is now closed, contact us and make arrangement to pay. sent SAR request, they sent exactly the same stuff back as they did with the CCA request. I have drafted a letter in reply (see post earlier) not sure what to do now, any advice would be appreciated, thanks Pez

                        Pezman,

                        Not sure about this bit:

As the statutory time limit for responding to my subject access request expires on 25.12.12 and given this is Christmas day I hereby give you until 05.01.2013 to provide me with this information or inform me as to why you are refusing to do so.

They have 40 days from your first request. You might want to state:

As the statutory time limit for responding to my subject access request has passed, I require you to respond to this letter within 7days of it's date. For avoidance of doubt you must supply all of the outstanding data that I have requested and has been detailed yet again above. I will not accept yet another half hearted attempt on your part, to comply with my legal application for documents. Failure to comply IN FULL with this request, will instigate an immediate complait to the ICO and in tandem, a request to the FOS to investigate your behaviour in this matter.

You will be aware of the potential costs involved for yourselves if you faill again to fulfill my SAR request.

                            Pez,

We do not advocate changing templates. However as their time limit has not yet passed, I would consider sending the below. Leave the more detailed response until they have failed again.

                            Dear Sirs
                            Account No/Reference No: XXXXXXXX

I recently requested that you supply me a copy of all information that you hold about me. This has not as yet been fully responded to, in accordance with the provisions set within s.7 Data Protection Act 1998. For the avoidance of doubt, the documents that you have supplied to date are inadequate.

I clearly explained in my original letter what I expected from you, therefore your lack of diligence in dealing with my request has left me no alternative but to inform the Information Commissioner of this, and leave them to instruct you to deal with my request, if you fail to respond in the required timeframe. In the meantime, you can take this as formal authority that this account is now formally disputed and will remain as such until you respond in accordance with the Data Protection Act.

Attached is a copy of my original request. If you now provide the data, as requested, then I do expect as a gesture of goodwill for you to refund the fee paid being you have already broken the terms of the Act in refusing to deal with my simple request within the allocated timeframe given by the authority.

For clarity you have until the 17th December to comply with my request in full, under the Data Protection Act 1998.
I do, expect the main actions to be dealt with, as matter of course, and look forward to hearing from you in due course.
                            Yours faithfully,
