Hmmmm so I'm not sure if the letters crossed in the post, but the tone of the letters received today from BLS are definately not as aggressive as the ones before I sent the O/D CCA request!

However as I do not wish to make a payment at this point I won't be contacting them (as if I would contact them by phone anyway!)

I think my O/D CCA letter has placed them on the back foot a little........

16/8/2012 - Letter from RMA offering their 'free' debt management services though I have to phone them
So letter from RMA as follows:

Our client, American Express, has informed us that you are currently experiencing financial difficulties.

We are a free service available to American Express customers, offering you support and assistance in order for you to regain control of your financial situation and therefore manage your finances more effectively.

Our aim is to help you improve your financial situation over the shortest time possible.

We do not charge you for our assistance, either upfront or on a monthly basis unlike some debt management companies. If you are considering a fee charging debt management company please consider that this will prolong the length of time you are in your current financial situation.

Please contact our team of representatives on <blah> in order that we can initiate this and tailor a payment plan to suit your circumstances.

If you do not call us, we will assume that you are no longer experiencing financial difficulty and we will advise our client to refer your account back to American Express to recover the balance in full which may incur further charges.

Our team may also be contacting you on numbers what we have on record for you to discuss your account. If you have previously provided your mobile number we may call and/or text messages on this number. We therefore request that you keep your mobile number secure.

We look forward to speaking to you

Hmm so NO I won't be calling RMA - good luck to them calling me on the numbers they have on record. I changed those over 2 years ago!

I also think that a DCA has a distinct conflict of interest then setting themselves up as a DMC!

I think I will send them this http://www.all-about-debt.co.uk/temp...general/t5.php and see what they say.

I think I'll keep that one in the bag for now, especially as I'm not sure on the date the account was taken out. I know it was definately in 2007, just not sure which month.......

If I get a negative/aggressive response to my 6 month payment break letter then for sure CCA request would be next.

Yes this is very true. However my last payment was only a couple of months ago so SB isn't the end goal (yet) as theres no significant time elapsed. I'm looking to get to F&F offer if I can't UE.

If they reject all this then I will have to see if I can weather the 6 year storm. I know Amex are quite litigious though so doubt it will get that far. I am happy to try though

                      Yes for sure - I don't disagree

What I like to do is give the DCA's enough rope to hang themselves with and then hit them with the 'big guns'.

I've already had 20% of the debt reduced as a 'goodwill gesture' from Amex due to harrassment from their DCA's (I was able to prove they were making threats that they couldn't legally carry out at the time), so unless they're really stupid they are going to be cautious dealing with me!

Likewise I'll be cautious with them as I'm sure they'd be itching to get me a CCJ

Yes I agree - I just want to save this one in the bag for a little bit. If I can get them to agree to a 6 month break this would be just as good as I'm looking to make F&F offers in a year or so.

But I suspect that they won't go for that so I will be issuing a CCA request very soon!

As you will be aware we have communicated with you over a period of time to resolve this without the need for legal action. Costs incurred as a result of any litigation will be added to your balance, if we succeed in obtaining a judgement against you.

I will not be demanding payment in full. I will be open to suggestions from you on how this account can be settled.

If you contact us before 29th August 2012, I can offer you a settlement figure on your outstanding balance. That means you only have to pay xxx to clear this account with us, and if required you can pay this over a 4 month period.

You still have the opportunity to stop legal action and the possibility of settling your account over a period of time and by a method that is suitable to you.

I trust that you will take this opportunity to contact us and save yourself the possible expense of litigation and the problems that any litigation in which we were successful would possibly cause to your credit file.
