Your giving them an awful lot of information there, I don't think I would be generous, a one liner saying it's in dispute would be what I'd do. Hang fire and see what Niddy thinks.

You may be right, I was thinking that by giving them that much to think about that they would just pass it back and move on to 'easier' prey!

I agree with Dopes...don't give them any more than you need to. Save that letter in case they come on heavy.

          Hiya

          So email from ArcEurope today:

Your account with QuickQuid has now been transferred to ARC (Europe) Ltd for collection.

You must now make arrangements to pay the outstanding balance to ARC (Europe) Ltd quoting the reference number xxxxxx. Payment may be made by card securely online at http://www.arceuropeltd.co.uk using your reference number.

Alternatively, please call me as soon as you can on 01932 251000 to discuss your repayment options.

So I'm unsure what to do here.

          Do I ignore?

Or do I respond something along the lines of 'account is in serious dispute due to your clients numerous breaches of the CCA 1974' and leave it at that without giving the detail of my previous draft letter.

I don't want them issuing something through bulk claims and then having to defend so would rather get this lot to fall at the first hurdle and hand the account back.

          Cheers

I personally would hit them with your previously posted letter but pad it out with as much other stuff as possible ( however 'correct' it is.

£750 isn't a lot to argue over, but many do. As the saying goes 'If you can't dazzle them with diamonds, baffle them with bullshit'

edit; adding a phrase such as 'attempting to force this issue through a Court would be very time consuming and expensive in both time and money for the Court so it would be in your interest to address the points raised NOW' puts the onus on them. I was taken to Court several years ago over a £170 debt, used this phrase and the Court agreed a £1 per month and hit THEM with costs of over £150 .

Well the 10 days have come and gone, so I guess I'm going to wait for the next letter before I make a response.

Its a question of 'know your enemy'. I've done a bit of research and ArcEurope are a bit like Bryan Carter, and fire off lots of claims to the bulk processing centre at Northampton.

I'd prefer to head that off by being more trouble than I'm worth (whatever commission they're going to make on a £750 debt) but as previously said, I'm not sure I want to give them my skeleton defense up front!

1/8/2012 - Letter received from BLS Collections. I appear to be in arrears on my payment arrangement. Unless I bring my arrangement back on track within 10 days they may take further action to collect the full balance.
Another letter received from BLS collections. Not sure what letter to send this lot at the moment. I don't know whether to try an O/D 'CCA Request' or a 'I can't pay anything at the moment please put my account on hold for 6 months' type letter...........

if you can get them to stop payments for 6 months, you could save enough to do a F&F therefore getting rid of this mob

if you query it with a CCA you could again spin it for a quite a time, it might just go away or again you can you could save enough to have a f&f tucked away should you ever need to use it.................

I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

If you spot any spammers, AE's, abusive or libellous posts or anything else that just doesn't feel right then please report them to me as soon as you spot them at: webmaster@all-about-debt.co.uk
