    A couple of things happened this week that made me re-evaluate things a little, and my thoughts are if I get CCJ's now then its no worse than a creditor applying a default to my credit file (or even go for a CCJ) in another couple of years time. In fact, if anything, its actually better for me longer term.

    Happy to be a 'guinea pig' for the DMP -> UE approach!

      Good luck on starting your UE journey...better late than never!!

      BTW you're not a DMP---> UE guinea pig, others (including some mods) have gone before you

        Looks like my first battle will be with Quickquid and ARC Europe. Got a nice letter to compose to them later this evening!

        Good to know theres others too have done DMP -> UE

        I know theres risks, but the DMP although it has kept creditors off my back, hasn't really helped my financial situation a great deal. I think that if I had started what I'm doing now 2 years ago over half the debt would have been wiped out already.

          I and my husband did dmp for four years , what a waste of time and effort, when we realised the dmp was getting paid on time and the mortgage was falling into arrears we realised we needed to take a different route and this is when this wonderful forum showed up and we got instant help from everyone, its a great place . I was really unsure at first about taking the UE route ,but now it feel its the best thing we have done and wish we had done it years ago.

          So here we are , we have sent of 22 CCA requests although some of them are overdrafts , and we are saving £43 a month as we have stopped our dmp , now we are waiting for the replies , hopefully all UE , i refuse to speak negative .
          So we are on this journey together lets wait and see what happens

            Yep me too paid over £36000 over3 years and still owed the same thank you cccs, but since AAD debt has gone down £42000 UE
            £1030 per month.

              CCCS must have loved you.

              I'm glad that I went self managed out the blocks, I have been hearing some absolute nightmares from CCCS recently where people have been paying debts for years to only find interest/charges were not stopped, but CCCS carried on making payments anyway. So those creditors that were reasonable got paid off, but then others had built a balance that would take an equivalent time to clear. Not good, and not good advice, especially when the DMPs were 8 years or longer!!

                Yes I know sounds bad but to be fair the £1000+ per month at the time was a godsend with 20 creditors it really helped, but it was realising the debt wasnt reducing which brought me here.

                  nice to see you jumping on board, I knew sense would prevail, you tried to pay it back with gusto and like a lot of us, it didn't really work. You know banks aren't reasonable so it makes it really difficult to deal with them in a reasonable and sensible manner, they just don't get it, their outlook is too skewed, it's the money the money the money, and they don't care about the people at all.

                    It really is a sorry world where consumers cant argue that continuing to add interest over a long term dmp is unfair and can only be seen to be forcing more debt.

                    My mother had an arrangement with M&S to pay £1 a month, after a year when she cancelled it and went for the UE route, i noticed from a letter of theirs that they added interest during that whole time, and stuck it on to the balance.

                    Its plainly obvious that in a real world, that would be seen as not helping the debtor to repay his/her debts, but sadly they get away with this.

                    Another reason why they all need to be shown that enough is enough (to coin a template name lol)

                      Hi All

                      So Santander have been quick off the mark. Letter received this weekend.

                      Apparently because I had set up a payment arrangement plan, I have already acknowledged liability for the debt.

                      If I ignore the letter then this could result in legal action against me through the courts, or referring the debt to a door step collections agency.

                      So standard threat letter, nothing to cause any concern right now. In fact I would quite like someone to come and collect my doorstep as they'd have a difficult job smashing the concrete!

                        It was a combination of things, some personal, some to do with how some of my creditors have been behaving recently.

                        If they had left things alone I wouldn't have even considered stopping the DMP, but instead they've continued to harass and pester, and some have continued to add interest and charges, while others have 'lost' payments, when I've then had to prove otherwise.

                        I have tried to be reasonable, tried to negotiate, but instead they immediately upped interest rates, added charges, doubled the debts, etc.

                        So all in all, I have decided to become a little more bolshy and take an aggressive stance back.

                        We'll see where it takes me!

                            SnV you wont regret it, honestly.

                            Santander are quite funny, it seems theres a running theme at the moment, where people are trying to be convinced that payment is acceptance of debt, when all we are doing is questioning the validity of the debt.

                            No one is saying the debt is not owed or will be writen off. They know that, but yet continue with the flawed argument.

                                So this is what I'm thinking of sending to Arc Europe. Just want to check I'm not making an error before sending this:

                                Please be advised that the account with your client is in serious dispute with regards to the matters detailed further below. I respectfully advise that you refer this account back to your client to address the matters raised forthwith:

                                Your client has been advised on NUMEROUS occasions that I am on a debt management plan with advise from the CCCS. Your client has refused to accept the payment offer proposed, have had complete disregard for the Common Financial Statement provided to them, and have not provided any reason why they rejected this proposal. I should remind you that this immediately places them in breach of guidelines issued by the Office of Fair Trading in relation to debt collection, and also the Lending Code

                                Your client received THREE postal order payments in relation to the above account which were not then paid to the account. Your client made claims that they had not received these payments, yet they were sent by recorded delivery, and the Post Office have confirmed that the postal orders have been cashed. Your client has refused to respond to any correspondence on this matter, therefore the amount you claim is outstanding is inaccurate.

                                Your client has failed to supply an annual statement of account as required by them under the Consumer Credit Act 1974.

                                Your client has not issued a Default Notice to me, as required by them under the Consumer Credit Act 1974.

                                Your client continually makes claims that I have failed to contact them. However, as previously stated they have been informed on numerous occasions of my debt management plan, correspondence of which they have responded to. Such claims questions your clients integrity and honesty in respect to their claims and communication.

                                I would remind you and your client of the requirements made of you under the Consumer Credit Act 1974, and the Unfair Relationships Provisions of that Act.

                                I would also remind you of your obligations under CPR and your clients previous conduct all of which would be brought to a courts attention, should your client seek redress via court proceedings.

                                However I trust that this matter can be resolved amicably, but require your client to seriously address all the issues raised in this letter.
