    Account Opened: 01/2004.

    CCA request sent by recorded delivery. 03/03/2012.
    Received response to CCA request. Letter dated 22nd March. (This date is outwith the 12+2).

    21st May received letter from Mercers - Default notice.
    21/05/12 - Mercers. DEFAULT NOTICE SERVED UNDER SECTION 87 (1) OF THE CONSUMER CREDIT ACT 1974.

    22/06/12 - Mercers. Immediate action needed. A DEBT COLLECTOR MAY CALL AT YOUR HOME TO OBTAIN FULL REPAYMENT.

    19/07/12 - Mercers. Written letters to you, you have not responded. Passing debt to Calder Financial, a representative may call at your address.

    31/07/12 - Resolvecall. Barclaycard Account. Acting on behalf of Mercers. Should you fail to contact Mercers may lead to personal visit to your home and we may commence legal action.


    06/08/12 sent Our Templates | Unenforceability Templates | Threat by Creditor - To Commence Litigation

    9/08/12 - Letter from Resolvecall, account returned to Barclaycard.


    Hi All,

    Received a letter from Barclaycard, In brief:

    We've identified that we have been reporting inaccurate info about your account to Credit Reference Agencies, we apologise for this error and we are correcting it. Our reporting should have shown that your account had been defaulted.

    Your account will be reported as defaulted from xx September 2012 with a balance of £xxxxx. We must give you notice of our intention to report your account. You have 28 days to make a repayment proposal. Formal demand enclosed with this letter.

    Formal Demand



    We previously issued default notice informing you that if you are unable to pay off outstanding balance we'll issue a formal demand for payment. We'll update credit refrence agencies within 28 days of the date of this letter. If you unable to reach a payment agreement will report as defaulted and legal proceedings could be taken against you. Call us.

    So, is this anything to worry about, or is there anything I can do hear? I stopped paying this well before Septeember 2012.

    Yes, I know exactly what you mean. It can be very frustrating, that said I don't really worry too much about the letters I receive anymore, I try to look upon it as though I now get to frustrate and cost them money... that they are.

    Indeed, I2D is correct.

    But don't you just feel sometimes like saying, stop pissing around, bring it on. My defence is ready to file as soon issue a claim. My costs are also prepared. Not a good idea obviously.

    Long time no post - been quiet since December until today that is, received the following.

    Clark & Wells

    Formal Demand

    Dear XXX

    Been instructed by Aktiv to recover overdue debt.

    Clients have informed us they are unaware of any legitimate reason for non-payment, they would prefer amicable settlement but will not hesitate to COMMENCE LEGAL PROCEEDINGS if necessary.

    Call us to make payment.

    Was wondering whether to send "account sold in dispute" and "Threat of legal proceedings"?

    Any advice greatly appreciated.

    I don't think you need to reply to this, though someone may well say something different

    Obviously you're not going to phone them

    Did Niddy say this was UE because they responded with an online agreement when you applied by phone?

    We are solicitors, have been instructed by Arrow Global on behalf of Britannica.

    We have been asked to contact you and agree how the sum will be repaid.

    Our client has informed us that, in return for a lump sum payment in the short term, it may be prepared to accept less than the sum set out above in settlement.
