          Doesn't section 61B (3) of the Consumer Credit Act 1974 (as amended, tinkered with and largely made into a veritable pig's breakfast) - link - apply to authorised non-business overdrafts?

            im not entirely sure that is retrospective is it?

            And even if it is, the overdraft agreement is not a hard thing for the bank to produce, if they pass it to the correct department

              No, but it would apply if the agreement had been renewed after February 2010.

              Yes, of course, in much the same way that they can always be relied upon to provide a twue reconstituted copy of any regulated credit agreement.

                As per email, as you're paying £1 nominal payments into the OD just carry on with it, you don't want to be a test case on bank account supplying documents - well, not in my opinion anyway
                I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website.                     27/3/12
                    Send off all unenforceable accounts with Missing PT most are not yet response except 1.

                    Some accounts still have not responded to my CCA request either, I suppose no news is good news (I hope) and except this one received today 27/4/12 but the cover of the letter dated 6/4/12

                      The PT's are not the originals to that actual signed agreement so for now you should send this: ---> Our Templates | Unenforceability Templates | CCA Query - Missing Prescribed Terms

                            received response obliged to provide you with a 'true' copy of the CCA & most recent available statement to the a/c with amounts and due dates of future payments that still require to be made. In terms of CCA copy doc regulations, the 'true' copy requirement can be satisfied by providing a copy agreement at the date the card agreeement was made and plus a copy of the current terms of the card agreement. Records show that there is still an outstanding balance on the a/c is currently being managed by Financial Hardships Team, therefore contact them directly to obtain details of the required repayments to settle the a/c. I can confirm that yr a/c has not been sold. Emailed Niddy.
