    Allan my quote was not to you. Yours is CONFIRMED as UE by the lender so why would you correspond? You wouldn't.

    You're confusing two debates.

    NO TWO CASES ARE EVER THE SAME - REMEMBER THAT!

    I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

    If you spot any spammers, AE's, abusive or libellous posts or anything else that just doesn't feel right then please report them to me as soon as you spot them at: webmaster@all-about-debt.co.uk

      Garlok,

      Similarly - I think my post above should answer you. It's a totally different situation as the lender has confirmed no agreement exists and thus they will not seek to enforce.

        Thanks niddy, point taken and having now read the "whole" thread (which I should have done before getting itchy typing fingers ) I have a clearer understanding of which direction to follow.

        I will await contact from Fredricksons who Arrow have appointed to "Manage" the accounts, then hit them with copies of the UE MBNA letters.

        Now stop SHOUTING....

              £0000.00 secured debt as of 17/12/2010 fingers crossed
              on 14/07/2012 i now have £32.000 unsecured and £15.000 unenforceable [thanks to niddy and aad ]
              as of 17/03/13 its now £26K AND £15K UE
              ITS COMING DOWN SLOWLY WHILE STILL ENJOYING MY LIFE

                  no need to worry unneccessarily, if you've got a letter saying they can't find the CCA, why would Arrow suddenly find one.

                  We've got two like this and we're waiting to be contacted.

                  even although it's been sold on, they are still in default of your CCA request.

                              PlanB posted that the alleged debt could have been 'given away' by the original creditor.

                              If the alleged debt had indeed been 'given', then no consideration would have been given in exchange.

                              Hence, I sought to question whether or not the assignment would be quite valid, even before one started to consider the donor, donee and witness signatures on the deed of assignment.
