    I know you don't like this method Niddy.... it's nowhere near court though and CPUTR tends to keep it that way. I have dealt with Moorcroft three times but only used CPUTR the last time because it wasn't around re. the other two times.

    They returned the account to the OC after that letter and confirmed in writing that they were unable to produce any docs. Not heard a peep from anyone since.

    If you don't want OP to go this way though.... I won't be offended.... ....lol!

      If they ever take action against you then you utilise CPR to find the answer which is more powerful than the unknown CPUTR....

      Just my opinion, I personally do not rate the CPUTR route but believe it can work based on other comments so if you do it please bear in mind we strongly suggest (in the main) that you do not do it....

      Let the process get properly tested and then we can re-evaluate things....
      The point of CPUTR is to flush out any misleading statements they may be tempted to make prior to issuing court papers. Once court papers are issued, then CPR kicks in anyway.... but CPUTR seems to stop this happening; it acts as a deterrent.... and it's a good one.

      Both Bryan Carter and Green & Co. have backed off issuing papers and saved me a great deal of stress..... I have no desire to take anyone to court and certainly don't want any court papers myself if these can be avoided.

      Just trying to explain where I'm coming from, that's all.

        P1 it's cool I understand what you're saying and know it worked for you but you gotta admit its a risky strategy especially as they *can* ignore the request (as we're a consumer)....

        But if it keeps working great. That's what we need - so happy to promote it but have to add a caution at the moment as its unknown what truly happens...
        I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

            Which of the templates do you suggest then as i am not sure which one suits. Perhaps i should be butchering them both to make one?

                  Evening all,

                  Had another letter from moorcroft for OH's very old next account saying to pay up else they might recommend court etc and a list of costs that may be incurred.

                  Not sure what to send them, they have sent a totally blank agreement with nothing to link anybody or any account to it. It is literally just a photocopy of a stock agreement.

                  Any body any ideas, does this need to be put into some form of dispute until they come up with something remotely like an agreement?

                      Hi i2d,

                      cca request, rubbish recieved then cputr but this has crossed over with latest demand.

                      I just dont want them thinking we are pushovers and going the court route because they think it will be undefended etc.

                          Their clients they say. I suppose i just want them to know that what they have sent is a load of old tat and doesnt cut the mustard!

                          Dont want them thinking they have satisfied their obligations when they havent

                            Hello again folks,

                            Only a minor update. Seems like our letter requesting confirmation that an agreement is held under CPUTR fell on deaf ears.

                            Their response is to resend the letter they sent before xmas with what they call a cca.The letter even has the last date on it from november the lazy gits! (IE: It is a poor photocopy of an agreement you should sign but with no names addresses etc on it. Totally blank and straight off the printing press!) Naughty people!

                            There is no way they have it! They say we should call as the hold on the account has been lifted

                            Luckily i got home just in time as the dog has only chewed through some of it. Perhaps even he got sick of the shit they shovel our way lol.

                            Will go through the template library now to see what i should send.
