As you've already sent in the right letter, send it again with a covering letter saying nothing more than "Read my Correspondence"
They cannot take action when you're in the middle of trying to negotiate - a judge would tell them to bugger off - plus the paltry amount, bear that in mind!

Hi there Niddy!
My faxes are recorded on my phone bills and they also reply to them withing a matter of days-However I decided to stick to recorded delivery from now on. Following the vague letter I received from them in response to the letter you wrote for me, I faxed AND have sent recorded delivery the letter above saying I presumed they were accepting my offer of £10 per month for 6 months, but would need them to confirm this to me in writing. I have now received this today from them and at fever pitch as they seem to be blatantly ignoring me.
"Balance: £256.70"
"You have not contacted us to discuss repayment for this debt. We require immediate full payment or an acceptable offer of repayment to prevent any further action. In order to stop our recommending that our client undertake further action such as the instruction of solicitors to issue court proceedings we are prepared to accept payments of £20 per month. If you wish to take advantage of this repayment opportunity you must make a payment using the payment slip below. We will then forward more slips to you.
Unless a payment is received by 10am on 24/09/10 we may recommend court proceedings to be commenced against you without any further notice.
Such action could incur further costs and will affect your future credit rating. It is therefore in your best interests to give this matter your immediate attention.
Should you need assistance please contact us.

This letter was dated 17th September and I am furious. It seems that even the letter you drafted for me threating them with the ICO and FOS has had no effect-meaning they are confident they can win or they are incredibly thick!
I have not made any complaints at all yet to anyone so really do not know what to do-they are making me dig my heels in even more though, as I have contacted them all along and repeated myself over and over again-and now they are writing saying I have not contacted them to discuss repayment???????!!!!!!!
If you can find the time Niddy then please help me further with this?

Cheers mate - you can fax, as you'll have proof it was sent via your phone bill and/or a summary receipt (make sure that is switched on, on your fax machine so you have proof it was sent)... but when things get silly, then stick to postal mail....Originally posted by antThats me told! Thats me told! Will do Niddy-I think it's just because it's been dragging on for so long. Will definately get all letters sent recorded delivery from now on and keep hold of the tracking refs, and any correspondence I get from them I will post on here, and do nothing till I hear from you!

you've not made anything worse but try and stick to the plan - NO MORE faxes til you've spoken to us on here cos you can make things worse...... just post the reply they send and then wait for a reply from me..... rush things, make errors and you may as well pay the lot and be left worse off...

Yes I sent the letter you did for me-I have been dealing with them by faxing letters right from the start, as because of my health it's quite difficult for me to get out and about alot. They always seem to reply to the letters I have sent though over the past few months of this going on.
Only thing is I sent the letter you did on the 2nd September. They wrote back dated the 4th September with the vague reply, and I faxed the last letter saying I took this to mean they were accepting my final offer of £60 @ £10 per month for 6 months. As I said though I have asked them again to confirm that they agree to this before I commence payments at the end of September. I hope I have'nt made a bad situation worse??

Did they actually receive your letter? What does track and trace show?
You should only have sent the same one, with a cover page saying "see attached" - not said anything else so if you've not posted it then don't!!!

Hi Niddy and everyone else!
Quick update to the above-I sent the letter off that you took the time to post on here for me, then sat back and waited. I got a reply a couple of days ago from Moorcroft which reads:
"Further to you recent correspondence, I write to confirm we require a monthly repayment proposal you can afford and maintain, to enable us to assist you further"
I have written back now saying that their letter was very vague and I take it to mean that they and Ace accept my final offer of £60 at £10 per month over 6 months.
I have also put in in bold capitals that I require in writing before payments commence at the end of September:
Their acceptance of the offer. My credit file to be marked as settled and the balance set to zero. The default to be removed.
I've also reiterated to them that if they cannot agree to this, then to return the account to Ace and do not bother me anymore with their stupid games, as it has not only become incredibly boring but also taxing on my health. I have also told them the warning still stands that I will have no hesitation in making complaints to every single organisation that is in place to protect the consumer.
Hope I have done the right thing and not made it worse for myself-some advice would be much appreciated! I did try to log on and ask before I sent the last letter but the site was coming up as unavailable!

Thank you so much for hammering out that letter for me pretty much on the spot-that was so kind of you and it's a relief feeling like I have people on my side
I am going to send off that letter tomorrow and keep you all updated! I must admit though because of the way they have treated me since last year it has been tempting to say that because they have been so money-grabbing they are now not getting a penny (through me not getting the cca from them). I don't know whether I would be pushing my luck though taking that route, as at the end of the day I do just want it to come to an end-maybe it would be better to pay them the £60 over six months. Would I be within my rights to say that payment is on condition that my credit file is marked as 'settled' and the balance owing changed to zero? There is also a default on the account that they put on in May 2010, but I doubt I can do much about that now!
