    Isnt it amazing , Moorcroft not only have a PRE COURT DIVISION but also the MIDAS LEGAL SERVICES errr pre court division , they are one Impressive outfit ! never mind the bright yellow envelopes as well lol

    Hi Niddy

    Just thought I would let you know that so far, Moorcroft have gone incredibly quiet-this is since I faxed for about the 4th time that letter stating my final offer and the terms, and also I sent it recorded delivery, which they received coz they signed for it. Am not getting my hope up as you know what they're like-just thought I would let you know an update though, as I did'nt want you to think It had been sorted out and I had just cleared off without a word of thanks to you!

    Will post on here though if I do hear something!

    Hi Ant, yea just sit tight now and see what happens. They may write back and just say we already wrote to you and attach a copy, if they do then you'd write back and say sorry - I made my offer, take it or leave it!

    We'll worry about what to say next, when they come back to you......

    Hello again Niddy! Hope all is well with you?
    Well-I sent off this morning (21st) by recorded delivery: a letter saying: "Further to your correspondence dated 15th October I refer you again to my correspondence dated 9th September and 14th October respectively" I also used the link you kindly provided above about doorstep collections agents and put that in word for word. Then I sent for the 4th time the letter from 9th September with my final offer of £60 payable over 6 months etc, together with a copy of the letter saying I would welcome any legal action from the 15th October.

    When I got in from doing that there was another letter from them which says:

    Date 18th October.

    Further to your recent communication, I write to advise that we are willing to accept a partial settlement of £205.36 to close this account.

    Please make immediate contact with our office to discuss this account further.

    This letter is not one of the bog standard letters that they seem to throw around like confetti, with the signatue of that moron A J Martin.

    So-that is the really generous offer they have made-to knock off approx £50, which quite frankly they can stick up their a***S and swivel hard!!

    It seems to me that they are all over the place and are now clutching at straws since I told them to bring on the legal action-infact the letter has the air of someone who is now trying to just grab what they can-am I right in thinking that I may (with alot of help from you!) have finally got them on the run?

    I still don't want to back down and it will be when hell freezes over that I accept any offer they make-the only offer I am prepared to stick to is the one I made for £60-and not one penny more.

    This letter they have just sent will have obviously crossed in the post with the one I have sent today-shall I not send anymore for now? Just let them receive the recorded delivery one and see what their next move will be? I did think that if I send another letter now to answer this pitiful and almost needy offer they have put on the table, it might fry what brain cells they have got and get them really confused!

    Well I did what you said above after that last letter from Midas (part of Morrcroft). They still seem to be ignoring everything and making out that It is ME not trying to sort his out-but how can I sort anything when the letters being sent are being ignored-almost to the point that I have'nt even written them!! They seem to have changed tack now all of a sudden & I have had one of the below from them before.

    DISCOUNT OFFER

    Our records show that despite our previous letters you have failed to make any payment to us and therefore your account has now been passed to our home collection division for action.

    This may involve our local rep calling at your home within the next few days to seek to asisit and try to establish how you propse to seetle the balance outstanding.
    However in one last attemt to come to an arrangement to prevent more serious action our client has informed us that we may be able to offer you a SUBSTANTIAL DISCOUNT from your outstanding balance. If you want to take advantage of this offer or agree a repayment arrangement please telephone us asap.
    We would emphasis that if no satisfactory agreement is made with us or our local rep you may leave us no choice but to recommend to our client that solicitors commence leagal proceedings against you without further notice.

    Just ignore them - they cannot just "get a ccj" - if they dare to attempt such a silly move we'd have it struck out due to the problems, so basically do the same again - send a copy of the last letter you sent to Moorcroft with a cover letter saying you're not impressed at this carry-on and you WELCOME legal action, so you can portray to the judge exactly what a shower of shambles you're up against - and say that word for word, seriously - they are taking the michael....!!

    Hi there Niddy

    Well I have got another response to all of the above-this time from Midas Legal Services who say they are part of Moorcroft.
    This one is saying that they are aware I have failed to reach a repayment agreement with Moorcroft and that they are now reviewing the account prior to the possible recommending of legal action by external solicitors, acting on behalf of their clients. Failure to contact Moorcroft by 8th October may result in the issue of legal proceedings without further notice. It then gives Moorcroft address/phone and fax.

    I faxed the last letter on 9th September stating my final figure I would pay if you look above, and then on your advice when they responded to that very vaguely I put: 'Refer To Letter', and sent by recorded delivery a copy of the letter again. Looking at the online tracking it still says being processed through the network, but I know that Moorcroft have had either the faxed letter or the recorded one-they can't have not had either.Now this letter has arrived from Midas!!! I am not giving up but am really tearing my hair out big time now, as this just seems to be going round in circles and am worried that the next thing through the letterbox will be a CCJ. I don't know whether to hit them with unenforceability over the credit agreement, make a formal complaint to whoever I need to, send yet another copy of the letter or what to do.

    Please help if you can!!!

    Ok-I won't pay anything until I have acceptance in black and white, and won't make any complaints against them yet-ya never know-they may accept it finally!

    Thanks alot for that Niddy

    I have sent another copy recorded delivery to them, and hopefully they will realise that I am no way going to back down.

    Doubt you will remember with all the people you help, but in my last letter, I said before payment commenced on the 30th September I wanted their acceptance of my offer in writing. It's getting pretty close now to the end of the month so what should I do if I don't receive any reply by then-or another letter with them playing silly buggers? Should I pay the first instalment of £10 per month for 6 months to cover myself-or would I be lining myself up to paying the whole balance in full because they have'nt send an acceptance letter?

    In the last 2 letters sent to them I have asked them for their bank details also, which they have ignored-instead they have sent a bloody payment slip! I have their details anyway from awhile back though, so can use those with the reference number I have from them.
