Update:

Another letter recieved from hemaDROYDS today, exactly the same as a previous one headed court proceedings and that documents are being prepared and that after 7 days court proceedings will commence.
I replied to the last one with the threat of litigation letter and got that nice one back from the OC stating they couldnt enforce in court etc but their drones dont seem to have gotten the message.

So question is, do i reply again with the same letter or ignore?

To update, i have found a default notice after going through the other halfs correspondance that was 'hidden' away.

Bit of an odd one, it was only asking for the arrears but it didnt give a fixed date but 14 DAYS instead!!! That has to be a no-no?

I am happy to create my own reply if one doesnt exist but i want to make sure i only give information they require not anything that may give them a heads up.

Just a point here,I notice that the 'unenforceable ' reply letter states that they can still add interest and charges.How come if admitted as unenforceable?

UE simply means they cannot enforce the debt, the debt itself still exists and can still generate interest as per the terms and/or per the assignment - if they charge by the terms then you'll have whatever rate added as per your agreement, if they bulk buy the debt they usually add statutory 8% per annum to the balance (pro rata monthly)....

However they can and will actively pursue debts, regardless of status - UE only means they won't be able to enforce the actual thing in court.

I get you on the letter front, just because they treat us with contempt, it costs nothing to be civil in return even though they sometimes make you want to rip their heads off with their lies

I did see your story when i first got here but i have read so much in my quest for knowledge that you will have to forgive me if some of it overflows and gets lost

The above is the type of letter you do not send a creditor, however this is not my debt thus i'll talk like dirt to them until they start to listen to me......

Thanks Niddy, will leave them to it. Hope nobody minds the pictures being embedded but it might be useful for other folk to see what might come through the post and make things less scary for them. I know it helps me seeing other peoples stuff :-)

Got a response to Niddys threat of litigation letter and was going to type up the key points but thought what the hell. Lets just scan it up. They still ignored the point about the £1 going off the balance though, cheeky beggars. I did notice though that it is the main company that have replied and not the skivvys down the hall!

People afraid of bold type look away now haha

Mate that is good, it is MORE proof that they do not hold an agreement, just ignore them now - forget it, no action can be taken......

Just noticed that they have given the OH 7 days but the actual date on the letter is from 26th of june and we recieved it today on the 5th july!!!
I assume the 'S' on the envelope is 2nd class. So those 7 days were well and truly up before the letter arrived lol.
Good grief!

I assume the 'S' on the envelope is 2nd class. So those 7 days were well and truly up before the letter arrived lol.
Good grief!

Make sure that you keep the letter and staple the envelope to the letter so that if (read very unlikely) event that things got to court you have something else to throw at them.
