Just a minor update :-)

The letter that was sent in post #21 has been sent again (by Redoute not their hairy backed muppets Droyds), exactly the same but with two minor differences which i never noticed at first.
1) It has 'copy' printed in standard font above the address
2) Hidden amongst the text claiming they cant enforce but they can do... the line 'Please inform us as to why you dispute the balance' appears which wasnt in the original letter.

The dates are the same as they were in July etc and there is no covering letter. Quite bizarre. It now states copy but isn't due to the added line!

Perhaps they have run out of template responses and just decided to send the latest one again. They have said court proceedings will commence within 7 days in three separate letters now over a period of a couple of months and its yet to happen.

Who knows what they are thinking lol

Hi Niddy, thanks for looking in. I previously sent the Threat by Creditor - To Commence Litigation template to which i got the last response from Redoute stating no court enforcement was possible.

I just want to be sure as Redoute have admitted no CCA but want droyds to be aware of it as they sent another letter saying proceedings will commence etc etc.. Dont want them to say i didnt respond ;-)

Mate myself and in2 has told you what to do. Copy the la redoute letter and send it with a copy of that template we linked you to. Send it special so it gets there next day.

If they try and take action our on board solicitors would no doubt bite your hand off to take the case on. Don't worry ok?

ps you have no legal grounds to dispute it. It's unenforceable by admission of the creditor. Game over for them mate.
Can you clarify, what template did you send? Was it this? ---> Unenforceability Templates - Section 2

If not that's what you NEED to send with a copy of the letter confirming it won't be enforced.

Send the same as last time. Use same link.

Regards a court claim, the claimant would probably be the catalogue; the address for servicing would be dca and or solicitors.

I have decided to put this account in to dispute officially by letter. More for my benefit than anything else and just in case droyds get funky. Can anyone point to the template, i cant seem to see it :-(

Cheers swanfan, i will do that then. I just figured i didnt want them to think they could push something through that wouldnt be defended and that i didnt know my rights as it were.

No-one will be able to take action if they've admitted they can't find the agreement.

I'd just ignore the latest letter.

Also, if Droyds still refer to the client, does that mean they themselves cannot instigate court action but it would have to be the OC instead? Can anyone confirm this. Still cant decide whether to ignore this or just send what i sent before with the latest letter saying they cant enforce in court.
