Remember they are still in default of your first request, that still stands.

Re: A little advice please
think it's been to longOriginally posted by pompeyfaith View PostI2D,
I am thinking along the lines that as they have not complied with the last request the chances of them having a CCA are pretty remote, however so as not to throw good money after bad perhaps a CCA request reminder maybe in order here bearing in mind that they have already had the fee.

Re: A little advice please
I would be happy to if this is the way to go maybe they didnt think I would act on it possibly? x
Would I say this is now my second request and that the £1.00 po should not be used again to pay the debt?

I think the only way forwards is to resend the cca request

Re: A little advice please
All the more reason on this last one to turn the screw the other way and only pay if they can prove they have a lawful right to collect i.e it is enforceable which to date they have not proved.Yes thankfully this is the last one of many, I have gone without for a long time to get each one of them paid and worked so hard to do it so Im quite proud that this is thankfully the last one. Some of the debt companies have been totally evil and horrid they made me worry all the time scared to open my mail I used to leave the phone off the hook it was truely an awful time x

And that is exactly how these companies want you to feel!!Originally posted by mrs_m View PostI know Niddy I guess I just wanted any easy life as such, as in the past phone calls and letters from companys put me into a very very bad place but im stronger now and want this sorted x
I think that most, if not all of us, on this forum have been in a similar place.
The way to get sorted is by following Niddy's advice!
Having a chat and a laugh on one of the chat threads is a really good antidote to the worry the dcas may cause you.
Have you just got this one debt?

Glad to hear it, and yes it may be difficult at first however the long term gain is far better than what you where doing.
Once they get the message that you will not be messed about and that you know the score as regards to the law those threats will ease off.

Re: A little advice please
mrs_m,
Please trust niddy the advice he is giving is spot on, the days of the consumer being the king are long gone and we now have a cut-throat financial industry that has no morals at all.
We are just an account number on a piece of paper indeed they will move earth in order to get us to pay up even if they have no legal standing to do so.
The Financial industry has had too it good for too long with regulators and such that do not stand up for the truth.
It is now time to work all the legislation and guidance to our favour and by that I mean if they cock up and in which in many many cases they do we should not under any circumstances pay the price for that.
You have been given good advice as to a way out why because they have not supplied that all important document namely the CCA and until they do you are under no obligation to pay them a penny.
The Financial industry really is lax in the storing of documents that is there problemo not ours.
Many many documents also do not conform to the law by way of terms and conditions and the lay out of such it is not our job to teach them how to suck eggs they are after all supposed to be the experts.
To that end please follow niddys expert advise as he does know his onions and the prove of that is right here on this forum.
If you need help you will find it all here, and yes in that you are one of the lucky ones many consumers are not so lucky and are still scratching there heads for an answer.
