    Don't worry, one way or another this interest will stop as they'll default/terminate the account when they aren't getting their contractual payment. We can argue about getting the interest they've applied since you informed them of your hardship later, once someone sentient takes notice of your situation.
    For now if it was me I would resend the complaint letter with a brief cover note stating you have not yet had a response to your formal complaint of xxxx which they signed for on xxx, a copy of which is enclosed.
    In the meantime keep paying them the £5 a month so you have the moral high ground.

    Hi Elsa,
    I was going to send you a quick message yesterday to update you but i know your are busy so i thought i would wait until i got a response, as yet they have not replied, and i know it was signed for on the 12th so i know they have it. but i have not had this months statement either, what they did send me was a letter dated the 12th from R Fairhurst ( vice president) saying our records show that your account has exceeded my agreed limit for at least 3 consecutive months, and to please make a payment asap to clear the overlimit amount. ( which is now over £2000 )
    they also said to stop my account balance increasing due to overlimit default charges, they have temporarily waived overlimit default charges on my account, and if my account balance stays below my credit limit and remains that way for 2 consecutive statements periods, this waiver will be removed and i will be charged overlimit default charges for subsequently going over my limit. ( this part made no sense to me as it sounds like they want me to keep to my credit limit and then they can charge me... or maybe i am reading it wrong) anyway i didnt think that this was a reponse letter as it makes no mention to the letter i sent to them and was dated the day they signed for my letter so didnt think they would of even read it the same day.
    i also received my normal monthly email from customer services saying i have missed 4 payments and it suggests i am in financial difficulty, saying i need to fill in the I&E form or simply call us to discuss my options.
    but thats all i have had up to now... post hasnt been yet though lol.
    do you think i should send them a follow up letter just to say i still have not had a response, or should i just leave them to answer in thier own time.

    Hi TJ,
    I could do with a bit more info to see the best way forward with this..
    Do you receive any benefits at all?
    Do you own or jointly own your house?
    Do you own a car?
    Any other debts in your name?
    Are you concerned about your credit file? By all means make the complaint to FOS, but if that doesn't work, in reality the quickest way to get them to cease interest is to simply let them default and terminate you (by not paying anything). That way the default also drops off your file sooner. An AP (arrangement to pay) marker stays on forever, until usually 3 or 4 years after it's been paid and is not viewed that well by creditors.
    Let me know your situation then I can help you with the letters if you wish

    In the meantime, have a play with the Nedcab online I&E form:
    North East Derbyshire Citizens Advice Bureau

    As they're being pig headed about receiving an I&E, if you have zero income just fill it in as such and hopefully they'll then get the message, as they are currently using your failure to supply one as a lame excuse not to stop interest.

    hi all, had a reply from complaints dept, in which they have said sorry for the calls as it was a mistake on their system and it has now been updated so I wont receive any more calls unless I don't reply to their letters etc. they also have said as I haven't rang them with a I&E they will still charge me interest and charges ( I did tell them that I have no income in my 1st letter as I have no job, so I didn't think and I&e would be of much use, plus I also said I wanted all contact to be in writing so I didn't want to call them on the phone) what shall I do.....
    they have also stated that as far as they are concerned they have now exhausted their complaint process and this is their final response in the matter and if I don't like it I can go to the FOS within 6 months of this letter. I just don't understand how they think its ok to add more to the original amount owed so the debt just gets bigger and bigger and becomes even harder to pay off.

    Hi blueforyou, hope you are ok, sorry I haven't been on here, its been a bit mad here, I wasn't well and now we have had a death in the family.
    anyway my OH rang the FOS to enquire for me and they said to write to MBNA and complain that my letter regarding interest has been ignored and give them the chance to reply... so I will be doing that this week and see what comes back and if they ignore that I will put a complaint in to the FOS.

    I have complained to FOS about a credit card company who thought they were above British law, I got the interest refunded and compo of 25 quid

    it costs them £500 for every complaint

    get going!!!

    hi MrsD and Blueforyou, yes when I first wrote to them in December I told them that I have lost my job as they company I worked for had ceased trading and would not be able to make my normal payment until I found work, I asked them would they please not put anymore charges on the account and freeze all interest and I will send them £5 per month as a token payment until I get back on my feet. I asked them would they please only contact me in writing due to the stress I was under I just couldn't face speaking to them. they wrote back saying they have restricted my account and thanks for letting them know about my current financial situation and I should ring them to discuss the information they need or fill in an I&E, and then they will discuss the repayment options with me ( I didn't bother to ring them or do the I&E as I already told them I have no income and I don't, my OH is paying all the bills at the minute and gives me the £5 to give them.
    They then went on to say I now need to destroy my credit card, like I thought I could still use it......
    MRSD, I thought they where allowed to carry on adding interest until they default me or sell the debt, so that why I have not bothered to complain...just thought ...no point and I thought this is what they do to bump up the final amount when they do come to sell on as they will get more from the debt collectors if they pay a percentage of the final amount for it

    if you aren't blagging and are paying all you can afford I would be complaining to the FOS about the interest

    they are normally useless buggers but they can help in these cases
