        Morning all,

        Just received a letter from Lowell with some statements from late 2009 - early 2010 (not requested). The a/c runs from 2004 and my last payment to Barclaycard was September 2009. Every DCA in the country has had this a/c with zero success, it was finally purchased by Lowell last year. I assume this statement is part of their obligation to keep me informed?

        They also said a copy of my agreement is on its way! that should be interesting as the CCA from Barclaycard is junk!

              Their only obligation is to send you an annual statement and if they are interested, notices of arrears

                Afternoon everyone, letter from Lowell yesterday thanking me for my enquiry (well..no enquiry made by me)

                They also say Barclaycard have no record of my CCA request (they do because I have their response letter dated late 2009 and cut & paste botched CCA) Also included was a copy application form with signature as confirmation of my debt and unless immediate payment arrangements are made collection activity will commence. I previously saw them off with a Niddy legal threat template, any suggestions this time? They will struggle to produce anything resembling a valid agreement judging by their previous efforts.

                  I think I would be sending a cca request to Lowells.

                  If they say that the copy of the application form is the agreement then you can send CCA Query - Application Form Received - allaboutDEBT UK

                    Well, the ultimate "death threat" arrived this am from Lowell. Apparently Debt Managers will now be handling my account from end July and will pursue me vigorously for the arrears!

                    Debt Managers were the idiots who Barclaycard originally instructed back in 2009/2010 and were seen off with a sharp retort, never to be heard from again!

                    Lowell describe DM as "one of our approved collection agencies" Could Lowell have possibly sold this on to DM? Surely even DM are not that stupid!

                          Well, if you wrote to DM way back in 2009/10, you could save time by referring them to your letters sent then. That'll put a spanner in the works nicely...

                            Received the same as above today except substitute Fredricksons for Debt Managers! I never heard anything form Debt Managers so just wondering what Fredricksons will come up with, I'm looking forward to hearing from them!

                              I had pretty much the same agreement and palava you've been through. I can't even remember the dca that bought the account in the end, but wasn't Lowell.

                              Anyway, in the end I got so fed up, I chanced a CPUTR letter asking if they held a "compliant" agreement.
                              They wrote back actually saying they were "unable" to find an agreement and wrote the account off. It was even updated on my credit file as satisfied.

                              Odd, as they knew that I had a copy of the agreement you posted up?
                              Not saying you should go this route and the Nids has advised against CPUTR, just saying what I did in the end and what happened..

                              Ps,

                              On another account (with Lowells) I had only the intro letter from Fred's and zilch else. Next came a letter from BC stating they will be issuing court action, as instructed by Lowell.

                                Thanks for your input, I recall Niddy advising against using CPUTR in another thread so I decided not to pursue it, although it worked perfectly in your case!
